《中华人民共和国国籍法》 3 |( h! n1 Y, S

第一条   中华人民共和国国籍的取得、丧失和恢复,都适用本法。
( q6 F3 O6 |) }" v    第二条   中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。% x" X; y/ n  B0 [
    第三条    中华人民共和国不承认中国公民具有双重国籍。2 H! n0 B/ K! |1 \' {
    第四条   父母双方或一方为中国公民,本人出生在中国,具有中国国籍。
. r* b! C) d; j+ Z: B! o    第五条   父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。) i) B0 O, h  y7 V7 h1 x
    第六条   父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。2 }. W4 v  h0 ~
    第七条   外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:' u2 l' a' l9 j' X4 y" P: u* K0 W
    一、中国人的近亲属;
$ W3 h! C! w' K& Q' R    二、定居在中国的;
5 }& S1 R& D/ j7 e' h    三、有其它正当理由。
& T5 n: F- Y3 V! g    第八条   申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。. q0 @) _/ l8 j' I
    第九条    定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。
+ d3 J% m: G- I: k/ J( V0 [" f9 W    第十条    中国公民具有下列条件之一的,可以经申请批准退出中国国籍:
% w* h# R! Q9 ~' y, p( m2 {    一、外国人的近亲属;
) `/ t4 X, f( R    二、定居在外国的;! }1 k7 ]- S- C: ]8 _' {
    三、有其它正当理由。" D- V: \1 c6 x. h; Z9 E+ `
    第十一条    申请退出中国国籍获得批准的,即丧失中国国籍。  `8 Q- s! j. @3 F9 X) x: q
    第十二条   国家工作人员和现役军人,不得退出中国国籍。
$ ?; d% B& h) o    第十三条   曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。
: o( T# N% k) F8 G0 ^) T8 }" M    第十四条   中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。$ H( e/ U" q! j  ]7 h4 q: o
    第十五条    受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。! z8 i8 Y7 d" Q( }+ Z: L
    第十六条   加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。% V1 v% U5 p# J8 o
    第十七条   本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。( U* r$ H, n9 {9 M, L  M4 B0 T
    第十八条   本法自公布之日起施行。

This Law is  applicable  to  the  acquisition,  loss  and  restoration  of/ U! M* A; I2 g
nationality of the People''s Republic of China.# G* }9 p0 _! o. n7 h7 X  |* g
Article 2
( b! m$ A; B' A$ H$ uThe People''s Republic of China is a unitary multinational  state;  persons
" i+ Z: M. f3 P0 F' pbelonging to  any  of  the  nationalities  in  China  shall  have  Chinese! t5 x% N1 G0 X+ R  X2 t8 [
nationality.( J( K9 j) b8 B! P8 F4 a8 _" O0 l
Article 3
1 ^; V1 ?" a! c1 `" ]# [The People''s Republic of China does not recognize dual nationality for any6 D- ~6 {4 Q2 q3 `  _3 f
Chinese national.
# H9 z' A- U) e- a0 o7 WArticle 4
9 f2 b4 \, p7 \$ eAny person born in China whose parents are both Chinese nationals  or  one
8 `! S/ O+ a# zof whose parents is a Chinese national shall have Chinese nationality.
& |2 T# o. `4 |, iArticle 5
1 u9 F* g. W0 y# M  @Any person born abroad whose parents are both Chinese nationals or one  of
6 m, p" `' @8 M6 T1 ?8 b) [5 mwhose parents is a Chinese national shall have Chinese nationality. But  a2 r) c1 S* d( Z5 r, O' F+ Y+ T; s
person whose parents are both Chinese  nationals  and  have  both  settled% n% Z0 a: }9 n/ c: `/ k/ ^* h  g, \
abroad, or one of whose parents is a  Chinese  national  and  has  settled
# u$ l- x2 f( I1 b) z; {abroad, and who has acquired foreign nationality at birth shall  not  have" ^- t6 [$ b! ~

Article 6
8 Y" N" M& O( p6 x  Y" zAny person born in China whose  parents  are  stateless  or  of  uncertain+ D; j& z8 x. R" y
nationality and have settled in China shall have Chinese nationality.
! F# ^$ \! q) U& V4 D1 J" D. pArticle 7
: f7 D! k  [% yForeign nationals or stateless persons who are willing to abide by China''s% x4 j+ ?7 y0 Y  {  l  E
Constitution and laws and who meet one of the following conditions may  be
& S/ ]0 ?8 V9 S5 ~naturalized upon approval of their applications:
% |; v& ?$ A' ?& G2 O8 J(1) they are near relatives of Chinese nationals;" U2 g. R: z4 j. i
(2) they have settled in China; or
- F/ e4 a# ?" k* U8 |: O5 U7 [(3) they have other legitimate reasons./ U; `- r* C# O# [, H. [
Article 8
  Q7 @8 b- J" ~Any person who applies for naturalization  as  a  Chinese  national  shall
3 ?  F0 w( i: \acquire Chinese nationality upon approval of  his  application;  a  person2 ]) B0 Q" u3 M5 G' z: [
whose application for  naturalization  as  a  Chinese  national  has  been
; o$ V! k: ]( m- Happroved shall not retain foreign nationality./ w- y- h. R: x, c+ Q
Article 9
! s6 t& |. a4 Q* ?% b! `- Z9 W$ AAny Chinese national who has settled abroad and who has  been  naturalized
8 T. Z; P4 |4 ias a foreign national or has acquired foreign nationality of his own  free
) k  P, j0 Q/ C) B  Y4 G3 awill shall automatically lose Chinese nationality.
' |. A3 A& C4 F" Z- h7 K; fArticle 10, @5 v" C8 x: Y, w* ~7 ^: _
Chinese nationals who meet one of the following  conditions  may  renounce- o; f+ Q7 W4 s, }6 Q
Chinese nationality upon approval of their applications:
5 t0 S. d) c/ x7 p, h(1) they are near relatives of foreign nationals;
# O3 H) ]& a) N8 h" I(2) they have settled abroad; or* V8 T0 A( e/ Q/ N# P( r
(3) they have other legitimate reasons.
" I0 h) @+ }, @$ c  [3 n: S. OArticle 11" T2 \6 y$ d; `8 I' h* _8 g
Any person who applies for renunciation of Chinese nationality shall  lose
3 e. b" I5 s7 m7 f) X& ~Chinese nationality upon approval of his application.
' m2 f+ n9 B9 y  oArticle 12
# O3 i3 G/ C, ?$ }( T+ NState functionaries and military personnel on  active  service  shall  not
) b+ ]. o) b* |  \3 w, prenounce Chinese nationality.
( ], d9 q; C3 C! z. j5 V9 dArticle 137 U5 a; Y0 ?' h  \3 g8 v
Foreign  nationals  who  once  held  Chinese  nationality  may  apply  for: [, W/ ~3 ?9 m& c8 ^+ I
restoration of Chinese nationality if they have legitimate reasons;  those
$ s4 v; z. s; O5 x; Hwhose applications  for  restoration  of  Chinese  nationality  have  been% y- h! I  a, B# B
approved shall not retain foreign nationality.2 d; _# J. o/ A7 Z  V- O# F- D+ o
Article 14- b) y6 X# v0 N0 _
Persons who wish to acquire, renounce or restore Chinese nationality, with2 w& k/ b5 l" d/ [9 G
the exception of the cases provided for in Article 9, shall go through the
; o% u, y! [% ~7 d% t2 Nformalities of application.  Applications of persons under the age  of  18: I# t" E- ?: \: g
may  be  filed  on  their  behalf  by  their  parents   or   other   legal
1 I# |8 u" q( f- ]- S* Grepresentatives.
. u! }7 ~/ a6 q: b- xArticle 154 U' m6 f& v% P: u
Nationality applications at home shall be handled by the  public  security1 ~% H5 s5 E2 T) k3 L- H. G
bureaus of the municipalities or counties where the applicants reside;
) V$ d- ~( s: m4 B  \  v; a- _* wnationality applications abroad shall be  handled  by  China''s  diplomatic
9 Y. J7 n2 f2 X' r( L& `4 arepresentative agencies and consular offices.
5 \0 O/ M& A0 f6 f# Y( T' B; yArticle 16, j) ^1 W. Q( M) Q: H
Applications for naturalization as Chinese nationals and for  renunciation
6 `) r* J$ k7 X$ f1 @  ~1 ]6 Z  uor restoration of Chinese  nationality  are  subject  to  examination  and, A; c' [6 l! d' B, s
approval by the Ministry of Public Security of the  People''s  Republic  of
, e, c4 q$ t: V* gChina. The Ministry of Public Security shall issue a  certificate  to  any
1 S& s* G( I" ?' {' a+ Z5 Kperson whose application has been approved./ Q0 ]+ C) a4 u; G( X, Q9 a
Article 17
# ~' M  h9 s1 Z: [The nationality status of  persons  who  have  acquired  or  lost  Chinese! J9 s/ Z6 O: U+ Y2 t
nationality before the promulgation of this Law shall remain valid.9 N, |/ F8 O; U3 V2 c: N, _+ O
Article 18- d' `1 I2 q4 u& F: A1 b% P
This Law shall come into force on the day of its promulgation.
