! B: G/ i. B5 Z( T 第一条   中华人民共和国国籍的取得、丧失和恢复,都适用本法。
  v* v) i+ N' o    第二条   中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。! n1 ]8 J+ E- y
    第三条    中华人民共和国不承认中国公民具有双重国籍。+ V+ Q; E6 M) S* [# a+ c
    第四条   父母双方或一方为中国公民,本人出生在中国,具有中国国籍。1 H" i' _( n/ @- P2 I1 y, x* g  a0 o2 o: P
    第五条   父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。* E; i* r% A3 F* {
    第六条   父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。
, A9 s+ z" {" w& J    第七条   外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:
) s  x' z3 ^- Y& @5 L0 S    一、中国人的近亲属;  W/ O; d7 M/ @7 d1 j
    二、定居在中国的;) x# E) d$ n" W% L  t2 l, K9 L% B' B
    三、有其它正当理由。/ H& c- g0 Z1 c1 R( [$ q
    第八条   申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。
" ^( O$ W1 E. a    第九条    定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。
5 y6 N; e+ ?# u; P9 G    第十条    中国公民具有下列条件之一的,可以经申请批准退出中国国籍:* {8 _- Y7 B/ ~& \) W
    一、外国人的近亲属;- q$ r* P  T+ F( B! g
    二、定居在外国的;
# H4 X' c# n& F+ j4 \' X% ?    三、有其它正当理由。
" `! k- W7 C9 R3 g# v5 K    第十一条    申请退出中国国籍获得批准的,即丧失中国国籍。
. V2 A. X6 l  H; Y# i" b    第十二条   国家工作人员和现役军人,不得退出中国国籍。
) U' W; u1 N5 o    第十三条   曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。- c; R  P4 x% j, m$ H
    第十四条   中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。2 U& j  z  `" ], D" L4 c5 i
    第十五条    受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。
8 a& e( N7 a: r; y    第十六条   加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。
) N& G8 |/ X; e7 q  C    第十七条   本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。

! W5 o% U4 m! c# T' gThis Law is  applicable  to  the  acquisition,  loss  and  restoration  of
& h6 Z5 `; G% L$ I" ]1 i6 Hnationality of the People''s Republic of China., ]) F7 D- V( F
Article 2$ ^, K' t, s1 D
The People''s Republic of China is a unitary multinational  state;  persons/ t& P3 w, v% |& `. k# x' H
belonging to  any  of  the  nationalities  in  China  shall  have  Chinese3 x# f2 E4 m$ X: s
nationality.0 q2 E6 q+ j3 }9 v2 ^8 x$ n
Article 3
& N$ ~+ L2 A1 P# C/ @+ D0 ZThe People''s Republic of China does not recognize dual nationality for any
1 C+ B- u8 J, p- MChinese national.& ]. R' r7 w, l/ {. @+ ^1 e) _
Article 4( C) ]8 K5 J. _3 z2 j- D1 X- o
Any person born in China whose parents are both Chinese nationals  or  one
5 Z' p3 B4 S* x8 a8 z3 yof whose parents is a Chinese national shall have Chinese nationality.

5 x/ ]$ R3 @* f7 I% j1 wAny person born abroad whose parents are both Chinese nationals or one  of
$ t- i/ t* D4 F3 T9 C" Awhose parents is a Chinese national shall have Chinese nationality. But  a
2 l: o) w1 G+ {6 I' K' y- P* ^person whose parents are both Chinese  nationals  and  have  both  settled
/ ^" E/ K2 ^/ n( `$ T, E: ~abroad, or one of whose parents is a  Chinese  national  and  has  settled
$ m/ B0 Z( W$ [/ `abroad, and who has acquired foreign nationality at birth shall  not  have
+ V2 G+ d; ^, L2 q: bChinese nationality.% B$ i8 E. H* ?6 j
Article 6; z4 v! b% ^2 H% V# W9 z
Any person born in China whose  parents  are  stateless  or  of  uncertain
5 R, n, d3 l; z- G  @; Knationality and have settled in China shall have Chinese nationality.& N* B2 F& U) b- ?" a) n
Article 7) h; L5 u5 s& @; a- B
Foreign nationals or stateless persons who are willing to abide by China''s
: ~. W2 V" g4 W/ W/ ]Constitution and laws and who meet one of the following conditions may  be6 N0 B" U" [! z1 ?3 H2 L# k
naturalized upon approval of their applications:
, O* P9 I/ \4 f& U4 t. Z. {- X(1) they are near relatives of Chinese nationals;
4 |; V7 R9 I; t  R1 o(2) they have settled in China; or
1 k7 j3 R" q* }1 c2 a(3) they have other legitimate reasons.

* Y. g  d0 t6 U; W, h3 rAny person who applies for naturalization  as  a  Chinese  national  shall- Z" [2 ?3 u" E2 ^, q0 I
acquire Chinese nationality upon approval of  his  application;  a  person2 h9 ]& g- v7 @- p
whose application for  naturalization  as  a  Chinese  national  has  been
* N# r) I9 [$ s2 G- }3 Happroved shall not retain foreign nationality.
6 K: V+ k' O4 f# S% TArticle 9; C4 P. C1 P9 T6 _4 g0 Q: g
Any Chinese national who has settled abroad and who has  been  naturalized
: c& y$ X3 G& }$ Sas a foreign national or has acquired foreign nationality of his own  free0 k* F- C8 q( T- i
will shall automatically lose Chinese nationality.
. Y+ U& L) f; k7 {# g# d7 bArticle 10
* l  ~& d/ Y3 X$ w/ O! M4 aChinese nationals who meet one of the following  conditions  may  renounce' T* {& J& D# H% O" K+ a$ W
Chinese nationality upon approval of their applications:, U, I. S% p! n4 Q* V. D
(1) they are near relatives of foreign nationals;
' I6 Z5 ]4 h$ ?(2) they have settled abroad; or3 }* w5 e* _: R; ?) x) I$ }& z
(3) they have other legitimate reasons." A  D+ A8 y* H2 \* p# q( f
Article 11
/ i) C) N# j7 r5 J, ?5 Z/ a' X4 P3 `Any person who applies for renunciation of Chinese nationality shall  lose( y+ k1 C/ }+ _3 c( b
Chinese nationality upon approval of his application.; ^" e; m4 o% J
Article 12* [1 V' \1 V* G
State functionaries and military personnel on  active  service  shall  not
; V( Y/ O7 s% l, b" ]renounce Chinese nationality.
% F* T, r9 {) Z% `# ^Article 13- b3 b! p3 E  U" t9 |+ O
Foreign  nationals  who  once  held  Chinese  nationality  may  apply  for2 j4 p0 H0 I( w8 c% N, S! c
restoration of Chinese nationality if they have legitimate reasons;  those% U& C4 o9 H. G7 M: m
whose applications  for  restoration  of  Chinese  nationality  have  been& s/ u- f+ M9 K1 O
approved shall not retain foreign nationality.
5 v; J+ U! M  o! d4 _( l1 ^Article 14, Y8 t# v* H" z  |; B# K: x
Persons who wish to acquire, renounce or restore Chinese nationality, with- D! Z" K4 J- v4 p( ~( g+ m
the exception of the cases provided for in Article 9, shall go through the6 g& ]. [1 L4 I3 j2 Y7 A
formalities of application.  Applications of persons under the age  of  188 H+ n& J  ]# k
may  be  filed  on  their  behalf  by  their  parents   or   other   legal
. v, g7 H( t0 \' drepresentatives.
9 J# C& O* W0 t4 f2 UArticle 15$ p. u' m/ K- M& Z& m$ `' m
Nationality applications at home shall be handled by the  public  security" W. D$ x: m* ]% x. Q6 B
bureaus of the municipalities or counties where the applicants reside;+ o7 C2 X" {/ Q5 m2 `% x# o
nationality applications abroad shall be  handled  by  China''s  diplomatic+ r# O# f/ D, e+ _" E2 s
representative agencies and consular offices.4 J3 M/ q' z3 |" {! |; V
Article 160 z8 X' l) x# Z8 ^6 Y+ v
Applications for naturalization as Chinese nationals and for  renunciation
; y: K! H, B& {7 _6 D- W3 m, eor restoration of Chinese  nationality  are  subject  to  examination  and3 Y2 \9 Z9 ?( o: J
approval by the Ministry of Public Security of the  People''s  Republic  of, Q+ B" }: M+ ^
China. The Ministry of Public Security shall issue a  certificate  to  any
9 x; A, H5 t+ I; }" a+ r+ ~- X  o8 Yperson whose application has been approved.
3 `/ I" m4 d* E+ D3 p4 \Article 17% v: W* Q0 A) C$ y6 W
The nationality status of  persons  who  have  acquired  or  lost  Chinese
0 C' B) e% F4 h/ e& t' Lnationality before the promulgation of this Law shall remain valid.3 m8 s. W% e0 T3 M& X
Article 18
* X% j# ]- W% v2 QThis Law shall come into force on the day of its promulgation.
