第一条 中华人民共和国国籍的取得、丧失和恢复,都适用本法。; ^* v9 G. Q* a/ b
第二条 中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。) R) O+ }4 ~4 G( J
第三条 中华人民共和国不承认中国公民具有双重国籍。
8 B* A- g2 @/ w2 j+ ` 第四条 父母双方或一方为中国公民,本人出生在中国,具有中国国籍。
+ E/ B* z. u0 p, P; e 第五条 父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。
% Q$ v+ c1 A4 \. Q 第六条 父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。! s. F4 ~0 n0 g! E# s" p
第七条 外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:1 A$ m. V+ L8 | G9 M$ L8 f
一、中国人的近亲属;
% I; b5 S; E3 _$ n# A* ^. P5 } 二、定居在中国的;: G% z! u _5 O W
三、有其它正当理由。
0 B! T, e9 A, G& s, N/ @ 第八条 申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。4 J9 o2 B4 K" W( `& w+ E6 o- @
第九条 定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。
* z8 V3 S: L1 A- i0 O 第十条 中国公民具有下列条件之一的,可以经申请批准退出中国国籍:: M+ X" q* [& G e/ \( j
一、外国人的近亲属;* [9 ] Q7 [. f7 O5 L) O, G
二、定居在外国的;
; F3 k; \' G2 |- P5 ]& R# p% { 三、有其它正当理由。. G- ?1 O$ s, n( [- k9 \
第十一条 申请退出中国国籍获得批准的,即丧失中国国籍。! I. c$ [) E; Z( N4 K
第十二条 国家工作人员和现役军人,不得退出中国国籍。
; l3 u2 U3 o& o5 t C, d 第十三条 曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。
. @" S) o$ G. Z E E+ m( ? 第十四条 中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。! f$ c" s7 w5 A& ~) f8 O
第十五条 受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。
7 G. `, H' e) ]1 W" c# J3 Q 第十六条 加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。+ N; t7 D( D- t3 c
第十七条 本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。

The People''s Republic of China does not recognize dual nationality for any

Any person born in China whose parents are both Chinese nationals or one

Article 7
$ O8 m+ n+ H; U O% S4 K) O6 bForeign nationals or stateless persons who are willing to abide by China''s
! J5 W8 u6 Y3 k/ E( `- @# nConstitution and laws and who meet one of the following conditions may be% W1 s% V" E1 l+ Q$ O9 `9 B
naturalized upon approval of their applications:0 x1 h5 E+ O" X
(1) they are near relatives of Chinese nationals;
+ ~( \" w3 F0 j y: c0 o(2) they have settled in China; or1 U, U8 z4 J1 \6 G ^) M
(3) they have other legitimate reasons.0 x4 b/ e) R! F

Any person who applies for naturalization as a Chinese national shall) w( d4 \0 g$ R. ?7 r
acquire Chinese nationality upon approval of his application; a person2 B2 a; O+ ~% t! X* P- L! |
whose application for naturalization as a Chinese national has been$ I; N4 y6 P" t. m+ E
approved shall not retain foreign nationality.

Any Chinese national who has settled abroad and who has been naturalized) q, c2 P4 x% i+ c& f# \
as a foreign national or has acquired foreign nationality of his own free
. A O3 c9 q9 gwill shall automatically lose Chinese nationality. V; t2 E- {* U" V' k
Article 10! G3 ?9 X$ {5 S# K8 M
Chinese nationals who meet one of the following conditions may renounce
0 y( K0 N: T# h. h% GChinese nationality upon approval of their applications:
b$ t7 I) i/ w0 J3 X$ N(1) they are near relatives of foreign nationals;' H$ f6 g( T9 g+ T5 l2 l
(2) they have settled abroad; or
9 c+ b7 N# x; E: F* F( S(3) they have other legitimate reasons.: t% E" O. ^3 \
Article 11
2 C, S1 k4 Y- w5 v% O7 m& Y/ T, lAny person who applies for renunciation of Chinese nationality shall lose
7 ]5 o) s9 M5 ~% C; FChinese nationality upon approval of his application.4 d) D7 C, h' ]6 v
Article 120 @0 {. z* j! _. L
State functionaries and military personnel on active service shall not; ]7 @) ]0 v3 s- r5 R
renounce Chinese nationality.

Foreign nationals who once held Chinese nationality may apply for
, K: ~& O, w+ a( H2 R$ B. C+ ?restoration of Chinese nationality if they have legitimate reasons; those
( Q, i7 c3 c( l3 X- r2 }0 Bwhose applications for restoration of Chinese nationality have been

Article 14* p$ n( f5 w8 l
Persons who wish to acquire, renounce or restore Chinese nationality, with- V2 ?. \8 z# x5 `- d( ~' ?
the exception of the cases provided for in Article 9, shall go through the
9 a. U9 o! O* ?( m- B: Z. Gformalities of application. Applications of persons under the age of 18& x1 F; `0 P( ^
may be filed on their behalf by their parents or other legal
% ]# \# g6 ]( M2 V9 Hrepresentatives.6 q8 A# m- p% ] E1 C9 F& u
Article 15
+ \" Z# i; ]5 a: U0 l; M6 QNationality applications at home shall be handled by the public security
- U G8 W' P, o8 k# Zbureaus of the municipalities or counties where the applicants reside;
) I4 H0 t! X2 N* ~% ^1 [7 ]1 Tnationality applications abroad shall be handled by China''s diplomatic
8 F9 _2 S7 l9 m& B0 r! ?representative agencies and consular offices.
4 H H; N: Q' ]Article 16
' Z5 T7 i! ~ kApplications for naturalization as Chinese nationals and for renunciation/ k2 j/ j: c: }6 Y2 y! a0 d! {6 U6 h
or restoration of Chinese nationality are subject to examination and4 s9 ~) L' u) b; v1 s
approval by the Ministry of Public Security of the People''s Republic of
) W" D: U- r% A: N* F) Q4 L. |China. The Ministry of Public Security shall issue a certificate to any. A* d$ I0 E/ i
person whose application has been approved.2 c Z- K. E( f L
Article 17
7 m: v' H# X9 t; ]. | y7 HThe nationality status of persons who have acquired or lost Chinese3 w9 c$ W0 l) g* v; o. A4 {$ E* v' X7 ~
nationality before the promulgation of this Law shall remain valid.4 R4 B- q% H7 n& M5 X
Article 18
