第一条 中华人民共和国国籍的取得、丧失和恢复,都适用本法。
5 x. j( b2 T+ o/ n- ^' I/ ~ 第二条 中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。+ j( Z/ M& t: {2 e3 H1 Y9 k% V* N
第三条 中华人民共和国不承认中国公民具有双重国籍。
7 l8 o* H; g* F. M5 d 第四条 父母双方或一方为中国公民,本人出生在中国,具有中国国籍。5 p, D' b$ ~" Y2 d" j
第五条 父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。
" q7 H2 Z8 r2 f" T0 Q 第六条 父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。
( Q7 U' {9 `, H% Q 第七条 外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:7 T+ I+ h, w6 F- h% m6 t5 }; u
一、中国人的近亲属;
$ ]$ L0 }1 Q1 m* m8 } 二、定居在中国的;8 S4 V. f# {9 }- j4 A
三、有其它正当理由。
& B9 r7 T P, O R F 第八条 申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。' H6 x" P" B# `- |
第九条 定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。; G0 C6 A$ Z- ]
第十条 中国公民具有下列条件之一的,可以经申请批准退出中国国籍:& Y+ ?( l3 [* Q: b
一、外国人的近亲属;
! ~" p6 m+ A6 y$ s% n$ I5 Q) G1 }9 u 二、定居在外国的;

第十一条 申请退出中国国籍获得批准的,即丧失中国国籍。3 U9 d/ y& X0 [& Q, {1 }
第十二条 国家工作人员和现役军人,不得退出中国国籍。3 v: W# t3 {. F. Z
第十三条 曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。& w5 L6 z/ S. p+ v5 H9 i" u4 {5 O
第十四条 中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。% h& O3 L% d* b4 q, b. m
第十五条 受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。1 E1 V# y1 X. q+ v/ K7 @
第十六条 加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。

Article 1

The People''s Republic of China is a unitary multinational state; persons- t# |2 U9 o7 u
belonging to any of the nationalities in China shall have Chinese

of whose parents is a Chinese national shall have Chinese nationality.; J, W5 `# x* l/ Q/ L+ u
Article 5
9 |, ]2 c7 [- O' F* ~: bAny person born abroad whose parents are both Chinese nationals or one of0 Q- ^1 f1 p' o; a# }' R' l2 g. W
whose parents is a Chinese national shall have Chinese nationality. But a$ b2 e" Q! @8 s3 o8 t0 A8 o6 O+ ?
person whose parents are both Chinese nationals and have both settled8 T* q8 x) P9 N% J6 }8 X; \8 g
abroad, or one of whose parents is a Chinese national and has settled

Article 6

nationality and have settled in China shall have Chinese nationality.

" _% I- |' B. R% CForeign nationals or stateless persons who are willing to abide by China''s
3 g- A. [+ S, `; n. _. h, \6 J9 }Constitution and laws and who meet one of the following conditions may be
& `7 A; u# e9 o, D4 cnaturalized upon approval of their applications:( T2 g# ^" N: _, q! |* D E
(1) they are near relatives of Chinese nationals;
) S {' a9 G4 q z! ?7 n(2) they have settled in China; or
7 w# {* O% V1 e5 F- T(3) they have other legitimate reasons.4 P6 Z! k. @( N) g, V1 j! A+ E0 I
Article 8% }8 k& J4 g4 o& u9 }7 l: a# M) O
Any person who applies for naturalization as a Chinese national shall- q' G6 Q3 V F# M
acquire Chinese nationality upon approval of his application; a person
9 l y/ z) Y. |1 ~& c# j4 h& T9 swhose application for naturalization as a Chinese national has been
, w4 w t, `6 Mapproved shall not retain foreign nationality.- u: `) b- B0 S3 j' O1 s8 W- w
Article 9( W3 a: L! O6 e5 y
Any Chinese national who has settled abroad and who has been naturalized5 ]( q3 h% z2 n' z
as a foreign national or has acquired foreign nationality of his own free/ a' B0 m0 B* I, k! v- t5 u) B
will shall automatically lose Chinese nationality./ i0 v9 d+ p- r P C
Article 10/ k/ h: K- Q. N7 L+ b7 f- d; _+ p5 j
Chinese nationals who meet one of the following conditions may renounce
4 l( |* G% w4 Q& L1 Q( a4 w! L; TChinese nationality upon approval of their applications:
) S6 B" Y) ^3 {9 z, l7 G6 o0 J(1) they are near relatives of foreign nationals;3 H6 x. w. R2 n" A, j
(2) they have settled abroad; or
; F/ f$ }: A0 m. w, P Q$ _(3) they have other legitimate reasons.$ X/ i4 D" Q3 U7 H9 ?
Article 11
: `9 n; ~! |% _Any person who applies for renunciation of Chinese nationality shall lose
& u' B. J& A% {" h: n. XChinese nationality upon approval of his application.5 E. V% S% d5 a5 Q: r: D1 e
Article 12* }! b" _5 Q/ T; M! N
State functionaries and military personnel on active service shall not
9 I+ T5 F0 G$ v: ^+ y& mrenounce Chinese nationality.

1 i" S" ]) O3 H1 K& {Foreign nationals who once held Chinese nationality may apply for
( X' t( X2 w, q: e; R/ P+ ?restoration of Chinese nationality if they have legitimate reasons; those. [) e& U' m+ ~
whose applications for restoration of Chinese nationality have been: v' p6 L6 u3 K' K
approved shall not retain foreign nationality.

0 L8 ^3 U; `: E5 H0 {- u- i' A' JPersons who wish to acquire, renounce or restore Chinese nationality, with' s: e2 j) W! F2 t9 K
the exception of the cases provided for in Article 9, shall go through the
) i, E. j4 K0 m3 i. C! v+ d( zformalities of application. Applications of persons under the age of 18
3 S8 G( ]9 ~( h( ?( p9 zmay be filed on their behalf by their parents or other legal
+ f6 I3 W8 x) _3 o7 X' T1 z# Arepresentatives.0 Q/ i4 k2 l8 o, Q# f4 ?- m
Article 15
" l/ w: u5 \ B% q5 aNationality applications at home shall be handled by the public security- S7 Z6 n$ }; m a, j
bureaus of the municipalities or counties where the applicants reside;" w, H0 I$ ^- H
nationality applications abroad shall be handled by China''s diplomatic
. B- `6 `* v! ?9 B- W' q; Drepresentative agencies and consular offices.
, C$ M( S* J# v& KArticle 16. i9 P6 M9 b9 o% b
Applications for naturalization as Chinese nationals and for renunciation: c- R) T b) G& A5 o/ ^
or restoration of Chinese nationality are subject to examination and3 a) U7 J6 F$ e
approval by the Ministry of Public Security of the People''s Republic of$ A, J8 g5 M( b l, F
China. The Ministry of Public Security shall issue a certificate to any
4 L: ], ~7 d* ^3 h' O$ i$ Kperson whose application has been approved.

. u: @% t9 M! _+ s7 |The nationality status of persons who have acquired or lost Chinese
5 w. ^' C c1 e% anationality before the promulgation of this Law shall remain valid.

This Law shall come into force on the day of its promulgation. |
