第一条 中华人民共和国国籍的取得、丧失和恢复,都适用本法。
4 J0 @3 |8 d. k$ O; x I( M4 H 第二条 中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。( Z( z& [ e. B; h0 c1 u/ x* v8 {
第三条 中华人民共和国不承认中国公民具有双重国籍。
. f. n# [/ X7 N; u; S 第四条 父母双方或一方为中国公民,本人出生在中国,具有中国国籍。
) C/ A8 T3 N8 V; B5 v# [' B 第五条 父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。8 P3 T" [4 n* l) {
第六条 父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。2 P H( R7 Z' a) B3 t
第七条 外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:

二、定居在中国的;8 O" [3 S# r9 I1 T2 Z5 e ]
三、有其它正当理由。
9 `7 @# N: r% c 第八条 申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。
! h% g6 J. q* l& g. } 第九条 定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。! s4 }& d: H1 J5 D8 n0 ]0 \, t
第十条 中国公民具有下列条件之一的,可以经申请批准退出中国国籍:# K. w. J6 S( U( v! ~6 z
一、外国人的近亲属;

三、有其它正当理由。
+ R7 E3 \6 F4 M; r6 X 第十一条 申请退出中国国籍获得批准的,即丧失中国国籍。+ H5 O8 P9 P2 H; L* D
第十二条 国家工作人员和现役军人,不得退出中国国籍。0 v# F2 Q5 R9 q( a0 e. c
第十三条 曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。
: F- u3 `6 H( Z+ x 第十四条 中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。# M6 X: G" ^ }
第十五条 受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。* r' ^4 d& m; H: q9 u% s/ w
第十六条 加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。
; }8 U: H5 h% \; j) Z% e 第十七条 本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。

Any person born in China whose parents are both Chinese nationals or one6 [$ L0 x0 j& s G+ m

Article 5
3 N7 ~9 A7 k8 m4 G3 L" yAny person born abroad whose parents are both Chinese nationals or one of
9 R4 F/ h' N/ ~5 `$ j, O3 E% I$ e; r: Iwhose parents is a Chinese national shall have Chinese nationality. But a

abroad, or one of whose parents is a Chinese national and has settled j/ s9 a# E; i
abroad, and who has acquired foreign nationality at birth shall not have+ @% G, }( U% L' ^8 s- E
Chinese nationality.

Any person born in China whose parents are stateless or of uncertain7 j B' _5 S1 f- B7 W
nationality and have settled in China shall have Chinese nationality.

$ z1 v7 P( D# j7 o7 mForeign nationals or stateless persons who are willing to abide by China''s8 X" k$ a3 p2 f! s1 q6 |: S ^: g( x
Constitution and laws and who meet one of the following conditions may be
% C& S( b3 ]# U# u% ^, rnaturalized upon approval of their applications:, w! h5 M& z' r+ D6 o' H J
(1) they are near relatives of Chinese nationals;$ o) H! Z: W- {" }
(2) they have settled in China; or$ z. g" y2 b# b6 [* u
(3) they have other legitimate reasons.0 K$ C' b2 U) W2 P; L' r) p

Any person who applies for naturalization as a Chinese national shall
W6 F9 o7 B& Hacquire Chinese nationality upon approval of his application; a person' p+ V1 f- Y8 R b7 e
whose application for naturalization as a Chinese national has been
G! g+ s( A% E& ], U, _approved shall not retain foreign nationality.3 D C) {- b, f4 b1 @
Article 94 J/ A+ }* \3 c3 I x6 y
Any Chinese national who has settled abroad and who has been naturalized0 M3 ]5 R8 l$ ]* g
as a foreign national or has acquired foreign nationality of his own free
/ r2 a: {) d) e! Swill shall automatically lose Chinese nationality.
; l" r, D" t$ R9 M' F) E/ cArticle 10' ?" e, N" G0 f" ~. A* }9 x( d
Chinese nationals who meet one of the following conditions may renounce
% F% E9 B4 | k# l' V( G, \Chinese nationality upon approval of their applications:

(2) they have settled abroad; or

Article 11
; z5 ~1 \5 g8 _* w; P: O5 PAny person who applies for renunciation of Chinese nationality shall lose
( v2 G8 {3 m' V) XChinese nationality upon approval of his application.

State functionaries and military personnel on active service shall not
5 j2 F" H6 A, `8 U, t% c* Q9 {renounce Chinese nationality.1 n1 U9 c# I6 G* T) U0 Y
Article 13
1 c0 N G- i8 H6 C! d3 bForeign nationals who once held Chinese nationality may apply for, o7 z9 ?6 }- `/ J- E2 A9 v2 S
restoration of Chinese nationality if they have legitimate reasons; those/ Y+ u1 q, `1 I! f
whose applications for restoration of Chinese nationality have been
7 K* z* D0 h) o" ^. oapproved shall not retain foreign nationality.
/ o- R2 c( h. P1 w5 s& D0 t5 LArticle 14 q+ m* T# C, F) |9 W; g
Persons who wish to acquire, renounce or restore Chinese nationality, with0 M- m8 V: N; R' G; L
the exception of the cases provided for in Article 9, shall go through the

may be filed on their behalf by their parents or other legal0 p' U* u% m+ K% u7 W! w! z. [
representatives.

Nationality applications at home shall be handled by the public security
( X1 E J5 e& L; W% Ubureaus of the municipalities or counties where the applicants reside;* W, i( A4 X% c- }" ]% k/ V
nationality applications abroad shall be handled by China''s diplomatic' q0 w4 n. A* j8 Y1 d2 |$ h
representative agencies and consular offices.+ N9 n" J, M# L, H9 t
Article 16) Y4 Q, A0 T5 h6 a5 H, y( ]
Applications for naturalization as Chinese nationals and for renunciation
2 m; J- r1 ~* O7 sor restoration of Chinese nationality are subject to examination and: X. p+ C1 Q/ |- ^# c# {! M
approval by the Ministry of Public Security of the People''s Republic of B# n- G. s2 o7 J v0 I
China. The Ministry of Public Security shall issue a certificate to any
( b' v, y3 c1 Lperson whose application has been approved.

: \8 @+ E) ~4 vThe nationality status of persons who have acquired or lost Chinese
& l8 e" [: ~# F7 b! ~3 _nationality before the promulgation of this Law shall remain valid.( b {6 E7 E/ N/ z( T
Article 18
3 A" {8 D* b( y4 p3 g. e* q9 aThis Law shall come into force on the day of its promulgation. |
