4 Y5 i) \& X Z i# @& q 第一条 中华人民共和国国籍的取得、丧失和恢复,都适用本法。# N$ T P' c3 @ P& B8 j2 n
第二条 中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。0 M3 U3 f, o8 z
第三条 中华人民共和国不承认中国公民具有双重国籍。
/ G; |: Y, H1 V0 h 第四条 父母双方或一方为中国公民,本人出生在中国,具有中国国籍。
3 B4 u d0 s/ y% n% o6 K W/ f 第五条 父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。
- m2 e+ {2 h# O) Z 第六条 父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。
) b* J$ v2 J( U* \ 第七条 外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:
& g1 z7 v! m$ h 一、中国人的近亲属;0 m4 x3 w% n) T8 K
二、定居在中国的;- r# r# n* y% o3 \7 ^% c. A% c/ J+ n
三、有其它正当理由。
1 j E" J4 R! b6 F, R" C6 J 第八条 申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。% C5 U6 y/ c2 `+ B
第九条 定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。% N7 O5 |: W& v ]
第十条 中国公民具有下列条件之一的,可以经申请批准退出中国国籍:
% [& h1 C( X! o5 q5 b 一、外国人的近亲属;
/ ~0 d( d. U( |* G 二、定居在外国的;1 f) {4 z/ y8 d5 G1 C
三、有其它正当理由。
' z% l3 L9 \4 l 第十一条 申请退出中国国籍获得批准的,即丧失中国国籍。
+ K9 U8 D3 H! W$ g- M# v# ] 第十二条 国家工作人员和现役军人,不得退出中国国籍。
7 y2 Q! U9 S* u% X' T: y7 m( |1 T1 u* D 第十三条 曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。$ {9 V# x4 \4 G0 y' Q
第十四条 中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。
4 M* X5 j# ^$ q 第十五条 受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。& f/ j: I9 D; l- A
第十六条 加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。
& }' V1 K K, h7 V1 A+ R& O 第十七条 本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。5 M8 v% [- \3 E8 F. j9 @
第十八条 本法自公布之日起施行。

The People''s Republic of China is a unitary multinational state; persons

nationality.

The People''s Republic of China does not recognize dual nationality for any

Any person born in China whose parents are both Chinese nationals or one
0 d) e% T& s; \) Q7 O# J) E4 `of whose parents is a Chinese national shall have Chinese nationality.' j# U9 m7 e% N

Any person born abroad whose parents are both Chinese nationals or one of
5 n0 c: B7 Q, W3 x$ nwhose parents is a Chinese national shall have Chinese nationality. But a
0 O) w t g0 F( ~, nperson whose parents are both Chinese nationals and have both settled

abroad, and who has acquired foreign nationality at birth shall not have

7 b C0 [1 V' l! wForeign nationals or stateless persons who are willing to abide by China''s
: f" f/ L; A- ]. W; GConstitution and laws and who meet one of the following conditions may be

% S! L! S% A/ }6 Y(1) they are near relatives of Chinese nationals;9 t( t" X$ O0 {' T5 r2 _% ]& j

(3) they have other legitimate reasons.

acquire Chinese nationality upon approval of his application; a person! ~: s4 v# R" X
whose application for naturalization as a Chinese national has been
, O3 w) |- u7 \" k% L) [3 xapproved shall not retain foreign nationality.8 g& D8 D; m) K
Article 9
; T2 h7 e, A! f1 D+ ~6 PAny Chinese national who has settled abroad and who has been naturalized
: |9 [ k ~1 w+ r) \5 g f5 Fas a foreign national or has acquired foreign nationality of his own free9 P% y& c7 J( }7 U
will shall automatically lose Chinese nationality.

0 D4 R% Q( c6 w: Z/ `, k f) ~Chinese nationals who meet one of the following conditions may renounce
" ]' E- _& A+ ?Chinese nationality upon approval of their applications:4 q: U/ Q1 o: R: G
(1) they are near relatives of foreign nationals;# Z! h) D7 l4 \9 G3 [: s( v
(2) they have settled abroad; or
# a3 C; }+ ^! v4 s- T. _# o(3) they have other legitimate reasons.

Any person who applies for renunciation of Chinese nationality shall lose
S& L0 k! ~6 @Chinese nationality upon approval of his application.% _/ I' j5 Z: {& T) c" F
Article 12
6 W& g( I' m- qState functionaries and military personnel on active service shall not/ ~; Z/ {# B2 K
renounce Chinese nationality." l \+ Q; x; e( h P w+ W

Foreign nationals who once held Chinese nationality may apply for/ j& y9 c/ q, ^$ g. |! d( _
restoration of Chinese nationality if they have legitimate reasons; those) z+ k1 L' m, A6 A; @% ~
whose applications for restoration of Chinese nationality have been
4 h) p5 }4 \6 G! Aapproved shall not retain foreign nationality.8 T. D: V( L3 L8 C, e; d; N
Article 14
9 @# ?; s* ^& @# C3 gPersons who wish to acquire, renounce or restore Chinese nationality, with) C# T3 X/ U, J" N0 i
the exception of the cases provided for in Article 9, shall go through the6 J3 v' H* v7 z- N' |
formalities of application. Applications of persons under the age of 18 ^. ^$ u' m- g! t! U
may be filed on their behalf by their parents or other legal3 t+ `4 B0 k. ^6 h7 l% x9 ~
representatives.

Nationality applications at home shall be handled by the public security
- c$ J( E8 b) |; [bureaus of the municipalities or counties where the applicants reside;
2 g1 e- T9 ^! w! u2 A$ s5 ]nationality applications abroad shall be handled by China''s diplomatic
$ x& C! e! I7 B drepresentative agencies and consular offices.

Applications for naturalization as Chinese nationals and for renunciation
8 `! g! w' e* tor restoration of Chinese nationality are subject to examination and
. t% R+ d- X2 eapproval by the Ministry of Public Security of the People''s Republic of) a d: g" x. Z: }+ G
China. The Ministry of Public Security shall issue a certificate to any
) G* n* ?% G& ` [- Gperson whose application has been approved.
4 A$ F+ Y8 L; q" B* ^" Z5 O" w1 {" AArticle 17
% ~7 O# d$ i9 CThe nationality status of persons who have acquired or lost Chinese
* Z# e8 U8 K |4 D& Z( d V/ vnationality before the promulgation of this Law shall remain valid.$ h4 ^6 V, a- R! ^/ I- w
Article 184 \, p+ `" j6 q
This Law shall come into force on the day of its promulgation. |
