第一条 中华人民共和国国籍的取得、丧失和恢复,都适用本法。- q, Z- Z+ _- {; K/ o/ ?, G
第二条 中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。/ b2 B/ K* v/ K/ Q5 v
第三条 中华人民共和国不承认中国公民具有双重国籍。& [! K% |# P! }8 z
第四条 父母双方或一方为中国公民,本人出生在中国,具有中国国籍。
2 Z5 e W5 ^$ ^' s) h 第五条 父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。
1 G6 ^* ?8 a: O7 j 第六条 父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。
3 Z2 Q" O( ~4 t% i- ~: c 第七条 外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:

( U& i, I& N4 B 二、定居在中国的;
; U/ w) {, o; P6 z' f' _$ K: t# K; U 三、有其它正当理由。
8 a1 B/ U. N+ r& X- Q9 L 第八条 申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。9 r' w+ A0 H5 U6 Y3 L7 o/ @& d% _% F
第九条 定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。# l, s7 ^/ I+ q1 \. Z3 K
第十条 中国公民具有下列条件之一的,可以经申请批准退出中国国籍:

第十一条 申请退出中国国籍获得批准的,即丧失中国国籍。9 ]; g P) Z0 e8 C! r* V
第十二条 国家工作人员和现役军人,不得退出中国国籍。
3 y& ~ k& [. s 第十三条 曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。8 j" L! W9 Y8 `3 L% v! L: v
第十四条 中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。1 Y$ c2 _3 C1 Q) _
第十五条 受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。
, ^# y3 u8 ~1 \2 S 第十六条 加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。
: T. V9 c. V7 W 第十七条 本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。
# D( M3 s1 i! ` i4 i% B* e 第十八条 本法自公布之日起施行。

This Law is applicable to the acquisition, loss and restoration of

Article 2
' ~# l$ W. L3 k% q3 v. }The People''s Republic of China is a unitary multinational state; persons
' E3 A, F1 R# c, d) A9 Ebelonging to any of the nationalities in China shall have Chinese; G' M, a, z4 e8 x6 x& B" d% w

The People''s Republic of China does not recognize dual nationality for any, b3 B& D9 b3 q8 c" t* v0 b7 d: E
Chinese national.

Any person born in China whose parents are both Chinese nationals or one
9 s/ O1 N* V" q) Y+ yof whose parents is a Chinese national shall have Chinese nationality.+ u+ l P* l: c
Article 5
6 n- c& k2 q) a+ e' k# ~+ ^Any person born abroad whose parents are both Chinese nationals or one of
: S0 z4 b; p& b. m+ M' Q# x4 x( bwhose parents is a Chinese national shall have Chinese nationality. But a+ t$ K- d* y/ L6 {. v7 p" \& h5 @
person whose parents are both Chinese nationals and have both settled
) E8 h8 R* R; u( O( F+ m* u' sabroad, or one of whose parents is a Chinese national and has settled
! @! Y% B, d% W; n$ b* Tabroad, and who has acquired foreign nationality at birth shall not have
' F6 a; j; `6 EChinese nationality.& w; g! u/ R) g% c" g% a
Article 6
) x6 t' X! O6 x* ? Z- z; B8 wAny person born in China whose parents are stateless or of uncertain! z6 U8 a8 Z+ p* h2 E
nationality and have settled in China shall have Chinese nationality.6 ^% K/ L+ R2 I1 N6 U4 S6 [( r& r
Article 7) H4 {* t+ A* e" q$ z
Foreign nationals or stateless persons who are willing to abide by China''s
5 G% l1 B: T7 b, `# w: h. s A: QConstitution and laws and who meet one of the following conditions may be
, u l. ~7 x \naturalized upon approval of their applications:
/ t' G7 o+ z( b( j- ^(1) they are near relatives of Chinese nationals;0 z1 z- w6 a8 |5 F, p4 U
(2) they have settled in China; or9 Y" U" b. o% |+ T
(3) they have other legitimate reasons.* n9 M# Z$ M, n6 R( q* _
Article 8) f" j I* J( s
Any person who applies for naturalization as a Chinese national shall$ T5 X3 M/ H$ u4 R; W
acquire Chinese nationality upon approval of his application; a person! r* r7 x# Y$ e) T5 i/ Q
whose application for naturalization as a Chinese national has been
. p( K5 ?# \1 b- ?approved shall not retain foreign nationality.
* Z9 i1 s, G4 [6 g# H8 O. }8 r! |) pArticle 98 U& a( M9 `9 U h3 S
Any Chinese national who has settled abroad and who has been naturalized
; s8 C5 U: Z% P. h' has a foreign national or has acquired foreign nationality of his own free
1 J9 J# C- f5 f" H" m4 A" {will shall automatically lose Chinese nationality./ W0 y- I* x& g+ e1 r9 X5 x
Article 10. Y) B. _. L/ ?4 W
Chinese nationals who meet one of the following conditions may renounce9 |5 g- u/ H7 n) N' ^
Chinese nationality upon approval of their applications:: `* h$ x0 q) x% p& M
(1) they are near relatives of foreign nationals;, R9 p E; ?) E' H5 K- _
(2) they have settled abroad; or
, [; y# M/ x4 l& S(3) they have other legitimate reasons.

Any person who applies for renunciation of Chinese nationality shall lose9 F: F% Z9 ?9 N3 ]
Chinese nationality upon approval of his application.( W3 x( o/ ?9 X2 F7 p
Article 122 q# g! ?9 Z/ t
State functionaries and military personnel on active service shall not
9 O: g! k6 I6 W: Grenounce Chinese nationality.
" L6 k( S0 x {9 B3 AArticle 13$ I3 @: I/ o+ |5 s' g% b
Foreign nationals who once held Chinese nationality may apply for, d! j4 a1 [+ q8 X% Q
restoration of Chinese nationality if they have legitimate reasons; those
+ X: t0 U+ F/ N6 m. nwhose applications for restoration of Chinese nationality have been1 R5 a3 _) j# J H4 }* W1 b
approved shall not retain foreign nationality.
( ~: c0 _. q% r- h' m# r2 ]6 kArticle 14& [4 ], t1 X+ S2 L5 \5 |& K8 c
Persons who wish to acquire, renounce or restore Chinese nationality, with6 i7 b0 a) _9 X: l! o M) q) k
the exception of the cases provided for in Article 9, shall go through the
% V! Z7 b6 b' Z4 Iformalities of application. Applications of persons under the age of 189 ~' A8 t8 J: j' a
may be filed on their behalf by their parents or other legal% u& q" d" e3 {1 m: K1 E5 s
representatives.' w3 K. N9 p% Z" j w% S
Article 15
+ Y* s7 Y6 ]0 }1 eNationality applications at home shall be handled by the public security- ~' T9 a1 P3 c' K3 \" I$ v
bureaus of the municipalities or counties where the applicants reside;8 p/ D _, u, D( M: |9 D
nationality applications abroad shall be handled by China''s diplomatic
( y& j; ^1 h6 g" b' k( trepresentative agencies and consular offices.

: O. \6 r; c: ~! J7 `$ LApplications for naturalization as Chinese nationals and for renunciation: e$ i# j$ |% e% W, v: J; g
or restoration of Chinese nationality are subject to examination and
2 W, n; j# C" N- U. O. Y( zapproval by the Ministry of Public Security of the People''s Republic of
4 }8 [3 ?+ y q* ]: A# hChina. The Ministry of Public Security shall issue a certificate to any* n6 c" c% N5 @5 U
person whose application has been approved.5 C* K2 Y: P1 q, @& t

The nationality status of persons who have acquired or lost Chinese
# M, W1 d8 t' _: j/ [: c( n% Unationality before the promulgation of this Law shall remain valid.7 H$ i# f |' j/ O- z
Article 18
. }( u0 J/ J! uThis Law shall come into force on the day of its promulgation. |
