2 M: Q  u# U3 ?4 f8 i《中华人民共和国国籍法》 , \3 E$ h% \4 n
  2 G- X7 b+ v! b; P1 ?2 p! E! [/ f
第一条   中华人民共和国国籍的取得、丧失和恢复,都适用本法。
% B: G, F1 R( R8 }    第二条   中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。
: T1 h) S# R4 U3 C+ t$ Y. u    第三条    中华人民共和国不承认中国公民具有双重国籍。
9 y/ P# D* D8 w; U. L    第四条   父母双方或一方为中国公民,本人出生在中国,具有中国国籍。
/ R  W, T2 Y% D5 d    第五条   父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。* J" m- K; R* B
    第六条   父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。
8 K9 P" B) i6 k- G    第七条   外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:
( E6 Q: b1 ~! Q    一、中国人的近亲属;! n$ C' L( A, D6 G
    二、定居在中国的;
  ?; w5 C; Q8 G* f0 ?$ g' z# E$ k    三、有其它正当理由。
, d; j2 x% k/ [$ {    第八条   申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。  k( `4 n5 |4 U8 k+ I
    第九条    定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。* ?9 B! ]. b: r- X6 V
    第十条    中国公民具有下列条件之一的,可以经申请批准退出中国国籍:
! E& h, o( y/ l0 q* |5 r    一、外国人的近亲属;8 j7 S9 m9 t2 q9 T  k
    二、定居在外国的;" ^' z, h5 L7 U# R
    三、有其它正当理由。
. W& q1 ~! ~, h2 \' x3 M% }  [* n    第十一条    申请退出中国国籍获得批准的,即丧失中国国籍。% P. {7 g/ c0 G, }& k) ~2 [
    第十二条   国家工作人员和现役军人,不得退出中国国籍。* q; m0 q' H2 k4 b% t) A) d
    第十三条   曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。
$ ~$ p( T5 y  ]) C9 ^    第十四条   中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。
& ]- _# L' a. J    第十五条    受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。
1 S! M+ @1 e# Y7 B5 z    第十六条   加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。
- P6 v" N$ b8 b' a0 T9 K    第十七条   本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。

This Law is  applicable  to  the  acquisition,  loss  and  restoration  of
5 l$ [& _: B/ S3 y: U1 x! `, V. znationality of the People''s Republic of China.2 m) [& Q1 j, }6 H9 N
Article 2
& w8 t/ X" ?7 X; b; zThe People''s Republic of China is a unitary multinational  state;  persons  Q, D$ u' {! ?: P( X
belonging to  any  of  the  nationalities  in  China  shall  have  Chinese
' \+ @$ Z* {7 Z' g; tnationality.7 @$ T4 e, g; Y
Article 37 t' g0 G/ C) o% c5 q; J% N' B
The People''s Republic of China does not recognize dual nationality for any( j1 I# b4 l# t4 O# S
Chinese national.+ V0 B. f! ]: |4 d, @: f# d) W
Article 49 s0 W0 K7 X' N0 c7 o
Any person born in China whose parents are both Chinese nationals  or  one
9 _* c, X- Y* Z9 Q) p% iof whose parents is a Chinese national shall have Chinese nationality.
- F  @2 f2 E5 C, N1 ?Article 5
7 Y6 d1 {. k) m7 T$ Z# w, B5 `* E- m' a6 WAny person born abroad whose parents are both Chinese nationals or one  of! z, n; X" ]2 p4 [0 G( e
whose parents is a Chinese national shall have Chinese nationality. But  a
% X! _( d; y2 N, Tperson whose parents are both Chinese  nationals  and  have  both  settled- z3 W# `8 \" a) D# M
abroad, or one of whose parents is a  Chinese  national  and  has  settled1 n7 I9 e3 M- k. S1 |
abroad, and who has acquired foreign nationality at birth shall  not  have* P$ {5 [1 V1 u0 K. [
Chinese nationality.
$ ]9 n: M4 E. h( r3 x5 ~* b7 b+ r7 E5 }Article 6
+ x& G0 I$ K9 T* z; j7 w( c1 DAny person born in China whose  parents  are  stateless  or  of  uncertain1 C" f; q. n( S- h( h* k  j
nationality and have settled in China shall have Chinese nationality.
* @7 a6 [. y' b* {Article 7* E: S% d# ]! v1 }" v
Foreign nationals or stateless persons who are willing to abide by China''s
' a! v& A' J& W1 OConstitution and laws and who meet one of the following conditions may  be2 O  ?* J1 C$ u$ r' |
naturalized upon approval of their applications:6 u1 p, X+ [5 q8 J* H! Q
(1) they are near relatives of Chinese nationals;
% D: P/ i7 a; U2 h9 V8 B' w(2) they have settled in China; or# m. m4 O* b7 f5 K  v
(3) they have other legitimate reasons.
# U/ k$ o5 z0 m, A- \Article 8
1 T$ `; B" e/ V0 k' K1 E) pAny person who applies for naturalization  as  a  Chinese  national  shall
/ b  H$ Y4 j: f4 m1 Sacquire Chinese nationality upon approval of  his  application;  a  person- K! f* ?: c  [% Z5 V
whose application for  naturalization  as  a  Chinese  national  has  been
: X: L) B1 \# X4 Q9 Q/ q3 @approved shall not retain foreign nationality.
$ W6 Z& Y" X( g. xArticle 9
. f0 ^8 w7 J# s6 S9 Y* YAny Chinese national who has settled abroad and who has  been  naturalized3 Y2 l/ @( g3 C+ U; H
as a foreign national or has acquired foreign nationality of his own  free$ V/ |) b4 T7 u
will shall automatically lose Chinese nationality.
( u% @' _( F6 C, gArticle 10+ a. |& a9 V& c3 C
Chinese nationals who meet one of the following  conditions  may  renounce) L* t1 C+ t& A2 Q6 c
Chinese nationality upon approval of their applications:
6 D( m7 A6 y5 O# {4 k(1) they are near relatives of foreign nationals;! z1 c" c9 c  v9 l1 U
(2) they have settled abroad; or
2 T4 F! v( q" P/ q) {4 ~(3) they have other legitimate reasons.
0 O/ M2 x  n2 E0 eArticle 11' f! e) g8 n( x) m' E& v
Any person who applies for renunciation of Chinese nationality shall  lose
; O' j+ o' M- R2 H- k5 X' ?& NChinese nationality upon approval of his application.4 R% \/ g. \( `3 n! b5 X* s+ ~6 ]
Article 12
# c* d. J& q: G# S  ZState functionaries and military personnel on  active  service  shall  not
' w4 [1 Z! d" ]1 lrenounce Chinese nationality.8 u- v3 h4 z6 r! f$ ~
Article 13
- L( s! B3 T. QForeign  nationals  who  once  held  Chinese  nationality  may  apply  for
9 T; d# h: f- J9 r7 w, I! [# yrestoration of Chinese nationality if they have legitimate reasons;  those% g" y+ U  e% B; |, y6 ~
whose applications  for  restoration  of  Chinese  nationality  have  been
; j8 k5 \" s: happroved shall not retain foreign nationality.
8 _/ W. o/ |+ C2 D2 ?! c, s8 hArticle 14  h/ ]+ P) }% V2 q2 _4 b
Persons who wish to acquire, renounce or restore Chinese nationality, with
# U% y2 H; d# cthe exception of the cases provided for in Article 9, shall go through the2 I. @, u! E5 x3 s" \" F; R: q7 [
formalities of application.  Applications of persons under the age  of  18
1 k1 R5 u% K6 E" n- y- `  Pmay  be  filed  on  their  behalf  by  their  parents   or   other   legal) z; o8 X9 d  b$ a7 u# k
representatives.2 k/ |0 u/ q  I0 R2 r2 i
Article 15/ T  g9 R$ Q( `# ^! G$ s
Nationality applications at home shall be handled by the  public  security
! P' F4 G; h3 U/ Qbureaus of the municipalities or counties where the applicants reside;
) Y) m. V' C' w* E% {nationality applications abroad shall be  handled  by  China''s  diplomatic0 k+ s3 Y2 l1 z0 Q
representative agencies and consular offices./ L; g  S- K1 L* a; c; {% p  `: w
Article 16
. x8 F' T* z+ w0 mApplications for naturalization as Chinese nationals and for  renunciation5 Y, Y: {  P9 T3 C
or restoration of Chinese  nationality  are  subject  to  examination  and2 m4 L8 e5 f: m" w# {4 n' f7 \
approval by the Ministry of Public Security of the  People''s  Republic  of3 e2 t9 H" }2 u) I! X$ ~( G! S
China. The Ministry of Public Security shall issue a  certificate  to  any
) Q  P  S) [8 b6 iperson whose application has been approved.
& p+ e/ N4 d  [0 c) P/ |* ?Article 17
7 T3 e8 L0 i3 P. ]  r" M4 \The nationality status of  persons  who  have  acquired  or  lost  Chinese7 `$ q' @  K+ ?6 F2 @  y# M- g
nationality before the promulgation of this Law shall remain valid.0 F+ I( k& W7 l* }
Article 186 O4 y3 L8 \, }' ~0 e/ N
This Law shall come into force on the day of its promulgation.
