第一条 中华人民共和国国籍的取得、丧失和恢复,都适用本法。& q& Z7 B4 ]% m1 k3 p
第二条 中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。) Z0 }: [7 `3 P8 G. r
第三条 中华人民共和国不承认中国公民具有双重国籍。* i. |9 e* S( X3 \+ E, V' f7 V3 `0 \
第四条 父母双方或一方为中国公民,本人出生在中国,具有中国国籍。
9 K, K* j; ~2 K; e4 z8 f8 G 第五条 父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。6 I9 k5 E: n, ~. ^8 g
第六条 父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。
, ]2 G- z7 o7 O# r 第七条 外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:" ~# Y6 b7 X& j4 ?. A T3 _
一、中国人的近亲属;
# h' Q3 A( E8 L! Q/ p; D 二、定居在中国的;& H% X. W) G# e% o& I
三、有其它正当理由。
' |# p( r) s3 H" F3 }4 y6 [ 第八条 申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。 J8 i) T# W/ p
第九条 定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。; i. T1 i: u/ Q( @
第十条 中国公民具有下列条件之一的,可以经申请批准退出中国国籍:; H- s6 F/ F+ `/ x% `- O" u, L
一、外国人的近亲属;
% b: w' }; e. X$ m 二、定居在外国的;
) {$ O" r# t, I% O 三、有其它正当理由。
4 L. x- h7 m% Y: ^$ i 第十一条 申请退出中国国籍获得批准的,即丧失中国国籍。
( Q+ I4 X7 k A! V; w. w 第十二条 国家工作人员和现役军人,不得退出中国国籍。
d7 K& W6 q$ y 第十三条 曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。
$ O) g$ v$ W) {" H: C 第十四条 中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。& s7 r* u% q1 y% Z% x) S
第十五条 受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。
8 A1 ]4 y8 Z8 t9 `# Q8 e 第十六条 加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。* C. P2 W3 `3 L9 ^
第十七条 本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。: T/ p7 Y2 g+ p+ e; N1 O
第十八条 本法自公布之日起施行。

$ j* C5 N2 s7 j% h, m/ \belonging to any of the nationalities in China shall have Chinese' Q3 t7 s) D. f4 u. W4 h) L' n

Article 3
2 K( m2 z: g9 {6 A+ \The People''s Republic of China does not recognize dual nationality for any

Article 4
+ B1 e$ l" d. I: K3 B3 y, lAny person born in China whose parents are both Chinese nationals or one
& j% l! }+ @; v5 g* X8 y& j$ nof whose parents is a Chinese national shall have Chinese nationality.) ^( t2 c* M- I4 f2 H' S
Article 5* k7 Z( K6 [' ^, J
Any person born abroad whose parents are both Chinese nationals or one of
. D% I; M# H9 H7 C" L! [) X V. nwhose parents is a Chinese national shall have Chinese nationality. But a
/ m+ q, E9 ]3 e. r) q5 `7 hperson whose parents are both Chinese nationals and have both settled
6 F: O) L. Q9 {. M' U% c0 D# qabroad, or one of whose parents is a Chinese national and has settled3 n4 H3 Q; p4 \3 f
abroad, and who has acquired foreign nationality at birth shall not have

Article 6' A' |+ v5 x/ ?6 y2 N, j3 F( s
Any person born in China whose parents are stateless or of uncertain
8 x x6 V0 i0 T, X. Tnationality and have settled in China shall have Chinese nationality.

! T A3 V6 ~- z/ X& d# i9 fForeign nationals or stateless persons who are willing to abide by China''s T5 e/ c0 p% v0 \7 w$ j2 X; ~
Constitution and laws and who meet one of the following conditions may be
8 E9 D8 y8 q7 f, H; C* N* Y% v0 gnaturalized upon approval of their applications: B0 w5 [0 [0 X# r& u
(1) they are near relatives of Chinese nationals;6 T8 d; @5 Y, A1 h- B
(2) they have settled in China; or
- W" P" z9 x1 z$ `) R8 s/ `9 F(3) they have other legitimate reasons.2 A5 U: A1 ~& ^: ` y }
Article 8
4 O0 j+ ~3 a, W' JAny person who applies for naturalization as a Chinese national shall5 ^ w0 M E& `% m6 O' v
acquire Chinese nationality upon approval of his application; a person
: o* X" W& x4 I5 a. W7 gwhose application for naturalization as a Chinese national has been. I" h! |0 ]# d( j6 I
approved shall not retain foreign nationality.

4 C( O( B+ U0 lAny Chinese national who has settled abroad and who has been naturalized, H# I5 f4 v# J3 Q
as a foreign national or has acquired foreign nationality of his own free
- E% {2 f) c+ W& }, uwill shall automatically lose Chinese nationality.
, ~* I- V/ L0 g$ [5 q+ p: x. WArticle 10
2 L) h9 y0 m! _ KChinese nationals who meet one of the following conditions may renounce% p, y6 W4 k8 K% Z
Chinese nationality upon approval of their applications:) Q( j& `0 B; I9 x/ y) d
(1) they are near relatives of foreign nationals;
) v8 R/ F( L9 \, g0 I(2) they have settled abroad; or' N! R$ q% A/ O7 d! {* U- _. g1 [
(3) they have other legitimate reasons. Y) k+ E5 T3 }& J* \2 n& h
Article 11
4 x, i/ S W! T+ tAny person who applies for renunciation of Chinese nationality shall lose
2 Z& G) N* N" `# c5 rChinese nationality upon approval of his application.

p# G8 ^* n5 G* s2 O8 w: F& \State functionaries and military personnel on active service shall not0 h2 N6 p4 a3 I% u2 s
renounce Chinese nationality.- d: }. ?# a; x* @$ A A7 q
Article 13
1 S' ?, b6 |4 N6 C2 nForeign nationals who once held Chinese nationality may apply for
( w% \2 \5 u/ b( m2 Xrestoration of Chinese nationality if they have legitimate reasons; those
X* w5 r8 f. p7 d+ D1 _1 [whose applications for restoration of Chinese nationality have been3 J4 `3 _' d# g S/ {7 J) w
approved shall not retain foreign nationality.+ S& v, U, ?7 J, h7 c
Article 14& y$ b2 d; z! x
Persons who wish to acquire, renounce or restore Chinese nationality, with
/ C) D2 D: r: Z) kthe exception of the cases provided for in Article 9, shall go through the
3 L% Y$ I1 `6 Rformalities of application. Applications of persons under the age of 18( }2 K3 W$ x6 a
may be filed on their behalf by their parents or other legal4 A6 e" o( ]$ S
representatives.( E r4 J& `6 H; _
Article 150 V' v3 r; C. d7 Z* R
Nationality applications at home shall be handled by the public security. S6 q! v/ L9 V& _5 W. J1 F: F
bureaus of the municipalities or counties where the applicants reside;
+ W. g" u5 c0 `; w v0 c% xnationality applications abroad shall be handled by China''s diplomatic% R- h1 I" Z% Q& w% f' D6 T; @6 \9 K
representative agencies and consular offices.) } l) A3 Y @9 Z- y
Article 16
- q) k7 v& I z6 p% A% O3 Y4 [# w; cApplications for naturalization as Chinese nationals and for renunciation4 {, l& Y1 Q m4 k+ U' s9 K' J, r
or restoration of Chinese nationality are subject to examination and
' ^- h) E0 U% d( k. kapproval by the Ministry of Public Security of the People''s Republic of& }7 { p0 O7 G/ U1 u& b1 x
China. The Ministry of Public Security shall issue a certificate to any; Z. E4 U& F) h
person whose application has been approved.
7 C# w7 H1 L# x5 fArticle 17% M% C5 \3 M0 T, X
The nationality status of persons who have acquired or lost Chinese8 P8 S/ s K0 j7 E. g9 x+ o/ I
nationality before the promulgation of this Law shall remain valid.

' ^5 I4 D! T( _9 ^This Law shall come into force on the day of its promulgation. |
