' Z2 F% E5 n5 O! f5 K* x' U 第一条 中华人民共和国国籍的取得、丧失和恢复,都适用本法。
% y% U* J' ^1 P 第二条 中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。
% y3 C$ K3 e+ a5 b* s2 X/ ? 第三条 中华人民共和国不承认中国公民具有双重国籍。
, t# W- E: F5 m5 m/ s 第四条 父母双方或一方为中国公民,本人出生在中国,具有中国国籍。
" x% }& l6 J: @1 m/ z$ B' \, l 第五条 父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。; ~- o' [) m( x4 N- J3 u
第六条 父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。' |; }& H' ^& {) h- I
第七条 外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:3 a' J1 V3 l4 y0 Z! k
一、中国人的近亲属;) e' }" i7 j, e5 N b o, i
二、定居在中国的;/ t0 H6 y4 A, m
三、有其它正当理由。
" |% \) k4 p2 p4 G4 C 第八条 申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。( ^& Y+ L7 {+ H
第九条 定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。0 K3 @3 R: d1 W: Q2 x
第十条 中国公民具有下列条件之一的,可以经申请批准退出中国国籍:9 @6 O0 R4 X3 y2 S7 C- Q0 k) H$ k
一、外国人的近亲属;3 ~. c& i" B) a! P, L
二、定居在外国的;
! b! A: T7 W I 三、有其它正当理由。0 C& }% r8 e9 o: t: `- ~ R* z
第十一条 申请退出中国国籍获得批准的,即丧失中国国籍。
+ }2 m0 q1 C) n5 y9 v& I2 X 第十二条 国家工作人员和现役军人,不得退出中国国籍。
2 d7 u, m8 u8 Q; `9 E 第十三条 曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。
6 n3 u7 `6 c: M8 ^1 c 第十四条 中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。
% v2 T _/ H4 e/ r# R" I0 B- h" u 第十五条 受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。1 \7 H; }1 ~, w8 {8 K. l8 `) ~
第十六条 加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。

; t! h5 X5 G, UThis Law is applicable to the acquisition, loss and restoration of

Article 2
3 d. T, h$ Z4 ?% nThe People''s Republic of China is a unitary multinational state; persons# E$ H& C. h# ^6 M: _
belonging to any of the nationalities in China shall have Chinese( I% O) X- n A+ F, Z! |; a
nationality.

The People''s Republic of China does not recognize dual nationality for any9 l Q* S8 M/ K( G
Chinese national.

Any person born in China whose parents are both Chinese nationals or one
; Q. i1 K7 N/ x$ e6 p3 i) hof whose parents is a Chinese national shall have Chinese nationality.

Any person born abroad whose parents are both Chinese nationals or one of: W8 g1 t( f/ L/ _ B/ W1 F
whose parents is a Chinese national shall have Chinese nationality. But a
4 @( b, N' \& F- Operson whose parents are both Chinese nationals and have both settled
. X3 p& J& \& r' ^& P k9 C# iabroad, or one of whose parents is a Chinese national and has settled
. k' q+ Z& i g% D0 labroad, and who has acquired foreign nationality at birth shall not have2 }; B) K" _- H$ F! q! z
Chinese nationality.

Any person born in China whose parents are stateless or of uncertain) T! m2 G' J. d/ |8 ]' o) _
nationality and have settled in China shall have Chinese nationality.

Foreign nationals or stateless persons who are willing to abide by China''s
$ i2 J% m" N& r5 ?/ I" `$ k' DConstitution and laws and who meet one of the following conditions may be* u" D! [: Y% ~8 l; |( g& a. S
naturalized upon approval of their applications:
: {6 f9 D' \" \4 d- z! [(1) they are near relatives of Chinese nationals;+ o3 q% ?& b. i0 Z' e
(2) they have settled in China; or) j; g9 K1 K2 B0 T. N* `2 r8 y
(3) they have other legitimate reasons.

: O( r* i# g6 I1 w' aAny person who applies for naturalization as a Chinese national shall" l) Q5 j6 C% @
acquire Chinese nationality upon approval of his application; a person
/ U, [/ T6 K! W# T, ^whose application for naturalization as a Chinese national has been% l, ^9 b2 i" y& w0 o
approved shall not retain foreign nationality.
" D4 C; i$ \* D6 U1 YArticle 9
" U: y7 j- Y4 f! s& q$ rAny Chinese national who has settled abroad and who has been naturalized
0 G8 c3 [' \& }; {" F% A' |as a foreign national or has acquired foreign nationality of his own free
6 Q3 H. D: G* T7 @) o% Hwill shall automatically lose Chinese nationality.2 `2 E1 M! C4 n" p# \ `
Article 10
: q7 Q4 g* W4 C- \3 X' KChinese nationals who meet one of the following conditions may renounce) {* Q. p5 U$ a( I' U& ~
Chinese nationality upon approval of their applications:
9 P: I; L2 N, b! P(1) they are near relatives of foreign nationals;
7 S) Y( A# D5 Q- Z. [(2) they have settled abroad; or$ L) c( M2 M3 @% z6 N) ^" q1 c
(3) they have other legitimate reasons.

. x y f3 X" M4 VAny person who applies for renunciation of Chinese nationality shall lose3 j9 C4 I; a7 X) Q" D
Chinese nationality upon approval of his application.( n0 D. y; q9 y Y' r8 G
Article 12: q. N& F L4 }) d
State functionaries and military personnel on active service shall not9 ~; z ?+ J/ ^1 u! T' L
renounce Chinese nationality.5 l. V! n6 K0 J, `# l9 ?+ c. _
Article 132 e4 ?" @# s# T! \" k1 H0 T
Foreign nationals who once held Chinese nationality may apply for
) c1 T9 j1 z( E$ j7 m9 s/ ^restoration of Chinese nationality if they have legitimate reasons; those( U0 m3 w0 r6 x H4 z. y
whose applications for restoration of Chinese nationality have been
' P; S, b. f5 p. R" r& H( Bapproved shall not retain foreign nationality.
/ a5 ^: x. W2 A2 AArticle 14. C( D4 F# L8 w+ P- {% M ^1 B
Persons who wish to acquire, renounce or restore Chinese nationality, with
~2 A' a8 x' [& @& ithe exception of the cases provided for in Article 9, shall go through the% @; J' x& h% \: V( i9 U+ o3 B
formalities of application. Applications of persons under the age of 18" @* v& `8 Z x, C" J; {7 Q
may be filed on their behalf by their parents or other legal
+ Z% T; f8 M6 p0 V3 @, Prepresentatives.
: f# o+ _ q4 }' N$ lArticle 15
- G# E" @" `" Z1 [+ l1 y/ C" O# [Nationality applications at home shall be handled by the public security) r; o H, ?- {% y( N7 |: I0 m
bureaus of the municipalities or counties where the applicants reside;
: y3 q a, {: [nationality applications abroad shall be handled by China''s diplomatic! y" X s1 [; _/ E
representative agencies and consular offices.9 ~8 k3 n ~ ?6 \2 J2 K) b
Article 16
" a" T$ ^& [* C0 YApplications for naturalization as Chinese nationals and for renunciation) \. ?2 @8 x: Y* v( K
or restoration of Chinese nationality are subject to examination and
8 j2 J$ z* _: ~4 ]approval by the Ministry of Public Security of the People''s Republic of+ k7 x6 d. f% |- U/ I, B
China. The Ministry of Public Security shall issue a certificate to any
2 w( \+ X: }7 j) l) Y' Rperson whose application has been approved.8 P* p2 O$ l: i( u/ m% ?' r
Article 17
) ?, w( t$ p( }7 u, v7 ^) q5 U$ b e1 oThe nationality status of persons who have acquired or lost Chinese
: }5 K* E7 i5 y0 V h0 unationality before the promulgation of this Law shall remain valid.8 ]$ q+ \1 z9 ^; B5 W1 K
Article 18 n8 X9 m. ] [7 G0 q0 K
This Law shall come into force on the day of its promulgation. |
