7 X* \; }. | R5 d 第一条 中华人民共和国国籍的取得、丧失和恢复,都适用本法。2 _+ b- ~. ^! M+ E+ Y5 r
第二条 中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。
^5 N6 F) _# e- d9 f& W- K' P X 第三条 中华人民共和国不承认中国公民具有双重国籍。
7 | H/ S1 g4 Z1 @5 z* \9 P0 O 第四条 父母双方或一方为中国公民,本人出生在中国,具有中国国籍。 v; r4 k) L$ c
第五条 父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。

& o8 k1 G+ O2 j 第七条 外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:
) E7 z. `" |) P8 H. e1 L: j 一、中国人的近亲属;
$ l8 A/ r! D: p! B! U& f8 D7 R 二、定居在中国的;+ r" k! z* q% w+ Y8 h
三、有其它正当理由。
, X0 A: Q# s8 b1 a: M3 r9 `/ z: c2 e 第八条 申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。
$ H# Z7 G; U" [0 B( _ 第九条 定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。
/ @! W0 h, J9 h. z 第十条 中国公民具有下列条件之一的,可以经申请批准退出中国国籍:7 Z2 d) G, N; b0 q7 f7 ] N. T, r
一、外国人的近亲属;
9 @) ^' l' Z- K$ n. w; h, `/ G 二、定居在外国的;
9 X9 N- |0 l( _) m$ ]6 e 三、有其它正当理由。
& S4 g2 C$ J8 L8 q& I: x 第十一条 申请退出中国国籍获得批准的,即丧失中国国籍。
: g. m% t5 L6 e 第十二条 国家工作人员和现役军人,不得退出中国国籍。
! h8 b- A' `: E! O, a 第十三条 曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。
! G5 V$ s' p* M. R. U( y 第十四条 中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。/ W' r# z$ I$ U( z7 q' Q3 L
第十五条 受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。
4 w3 t6 x2 O. z& H 第十六条 加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。
, P6 g+ {. g5 w& E 第十七条 本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。, s* M* T5 C' A1 d0 @

The People''s Republic of China is a unitary multinational state; persons

! S9 Y0 i$ p2 V I+ p) i5 w7 K% nAny person born abroad whose parents are both Chinese nationals or one of

person whose parents are both Chinese nationals and have both settled5 V: o' P6 B/ h. i$ s% k
abroad, or one of whose parents is a Chinese national and has settled% ^% j: [6 R8 U) K: _3 t) S; r
abroad, and who has acquired foreign nationality at birth shall not have6 B8 E6 I' W D

Any person born in China whose parents are stateless or of uncertain

' v: M7 }( [' b xForeign nationals or stateless persons who are willing to abide by China''s& K" T% }+ A* Z6 s3 J% `' n8 Y
Constitution and laws and who meet one of the following conditions may be; I/ x, ?: D8 W8 B. o% d: e0 p
naturalized upon approval of their applications:
7 p# ^6 h& u/ j' y(1) they are near relatives of Chinese nationals;
8 g4 x, G, y4 ^( s5 b! i7 e: `(2) they have settled in China; or
& |- D! W9 m! U(3) they have other legitimate reasons.

% G' z4 X9 h4 Y8 Iacquire Chinese nationality upon approval of his application; a person

Article 9
6 R. u H- C0 p3 D$ t6 i# sAny Chinese national who has settled abroad and who has been naturalized
5 X0 D9 K3 F4 s+ m+ V7 Pas a foreign national or has acquired foreign nationality of his own free
/ u- W0 O7 h( n# nwill shall automatically lose Chinese nationality.7 c; _) j; t z/ A6 ~5 e" F
Article 10
1 n1 E5 T) y! r" ~9 t# yChinese nationals who meet one of the following conditions may renounce
% T s) `% y& N o7 u+ Z5 ~Chinese nationality upon approval of their applications:: E p1 M" L# m6 o# r
(1) they are near relatives of foreign nationals;" h, t! T' f, A& S6 ]
(2) they have settled abroad; or2 q2 ]2 D$ ~+ R6 ]2 h# _0 s
(3) they have other legitimate reasons.* X& b+ m7 e+ z. v0 ~; D
Article 11$ |" m, T" Z" j+ `/ e" ~
Any person who applies for renunciation of Chinese nationality shall lose; Z! U/ J, T- X9 N8 j( c
Chinese nationality upon approval of his application.& {8 B& D1 ^) y1 m3 T
Article 12& X" A4 ^6 M: `* A4 A
State functionaries and military personnel on active service shall not# ], V1 w3 v" N( Q, u0 R( p5 C
renounce Chinese nationality.: W3 j7 S1 e6 _7 `: s
Article 13
4 |& z4 ]; ? J9 g: UForeign nationals who once held Chinese nationality may apply for
E' D; b) C9 R/ Qrestoration of Chinese nationality if they have legitimate reasons; those% ^. i \. L8 w. b# {" E
whose applications for restoration of Chinese nationality have been$ l1 {; Q- R. Z% C& j% N
approved shall not retain foreign nationality.

% `/ p0 \5 W V" a5 v" B' cPersons who wish to acquire, renounce or restore Chinese nationality, with+ \8 I) O) g* }: A
the exception of the cases provided for in Article 9, shall go through the7 W9 c9 g5 U& o& W8 p
formalities of application. Applications of persons under the age of 18& O2 F2 Y; @5 S
may be filed on their behalf by their parents or other legal
# D+ @7 s: M: S- H( ^+ ?0 ^representatives.

( y5 q. O" I T# fNationality applications at home shall be handled by the public security2 T. ^2 V6 ^# {6 @: o
bureaus of the municipalities or counties where the applicants reside;
% ?# O, l7 K1 H& ^5 m1 P& C- |nationality applications abroad shall be handled by China''s diplomatic
: M3 V2 B3 p rrepresentative agencies and consular offices.( X1 f( U7 S6 t! S# E
Article 16
) J& k5 @& x* T) @: B5 s; S, [9 kApplications for naturalization as Chinese nationals and for renunciation
: \4 a1 r" Q) r8 l& e. g3 |( {or restoration of Chinese nationality are subject to examination and
# s6 O. d0 x$ n9 t' C% Qapproval by the Ministry of Public Security of the People''s Republic of
; c. i1 i" `9 W) f0 Q' X4 M7 I: MChina. The Ministry of Public Security shall issue a certificate to any
% i: D) W5 b8 B$ D' G$ y; Qperson whose application has been approved.

8 j/ a9 S, l9 f# K4 Y" P/ RThe nationality status of persons who have acquired or lost Chinese
' N$ u6 M' I+ X* C7 b! B' pnationality before the promulgation of this Law shall remain valid.

This Law shall come into force on the day of its promulgation. |
