第一条 中华人民共和国国籍的取得、丧失和恢复,都适用本法。; D: @ p$ h5 X
第二条 中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。. h3 l- N, S* s/ T$ v. ^
第三条 中华人民共和国不承认中国公民具有双重国籍。
# R/ n; P; O! e- A 第四条 父母双方或一方为中国公民,本人出生在中国,具有中国国籍。/ J3 l" Y0 [/ u W9 J
第五条 父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。& j C w( S& B9 Z# S$ J3 t
第六条 父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。
7 n6 e$ }# \% e; b% K7 j 第七条 外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:

第八条 申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。1 H" o. G1 V8 c) Y6 J2 }3 y
第九条 定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。
7 |0 q1 I0 R- i& E. ], `, F 第十条 中国公民具有下列条件之一的,可以经申请批准退出中国国籍:& M# Z- m4 \: U* \
一、外国人的近亲属;
" k) e3 e& Y& p/ m2 B$ P3 } 二、定居在外国的;2 w8 g& v3 O$ t" H6 J7 c6 y5 ^

第十一条 申请退出中国国籍获得批准的,即丧失中国国籍。( m ` n' q4 L0 m7 m) F
第十二条 国家工作人员和现役军人,不得退出中国国籍。
2 ]7 t% [ a" ] 第十三条 曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。
# y& Y+ e* L6 @ 第十四条 中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。
2 Y1 a, v2 E' q" b O- r* M 第十五条 受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。% L0 w" t5 c1 L; Q% p
第十六条 加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。
& n& Q/ g7 G1 O+ ^: f7 R; M 第十七条 本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。

whose parents is a Chinese national shall have Chinese nationality. But a

Any person born in China whose parents are stateless or of uncertain

Article 7- A! F4 l, M9 X1 a
Foreign nationals or stateless persons who are willing to abide by China''s7 d3 E$ w' F* A8 A5 C6 u8 U
Constitution and laws and who meet one of the following conditions may be
+ Z9 w. ]& B- |3 s9 `" bnaturalized upon approval of their applications:2 v+ \: s: F0 M, K6 C, |+ @& g
(1) they are near relatives of Chinese nationals;
' s7 }; n/ H. ]' _(2) they have settled in China; or% j2 t! ~# Z q" u
(3) they have other legitimate reasons." h% w3 M2 m+ D6 A3 w s
Article 82 k: \# x0 g+ w" a0 A3 a
Any person who applies for naturalization as a Chinese national shall
: R9 e$ Z8 y0 {1 J% V1 [: ^/ Sacquire Chinese nationality upon approval of his application; a person" v5 q; l( n- G4 O) _
whose application for naturalization as a Chinese national has been7 V* \. y9 K1 D. E- M7 [4 P
approved shall not retain foreign nationality.
/ h% Y0 t) B9 JArticle 9" v, M: D, U: }
Any Chinese national who has settled abroad and who has been naturalized
; f2 \9 f, `% r! uas a foreign national or has acquired foreign nationality of his own free, }- x1 j9 d: {3 g+ t+ i: O
will shall automatically lose Chinese nationality.7 M2 r; _/ ^2 _
Article 10, @( e2 [% [' a) Q
Chinese nationals who meet one of the following conditions may renounce1 H( u3 T3 c7 s6 v
Chinese nationality upon approval of their applications:8 I" e4 e9 a* q) z/ }1 a! e% B
(1) they are near relatives of foreign nationals;( T" C$ z# U6 q# J6 c+ u
(2) they have settled abroad; or# n( y! V# |7 x% d+ V
(3) they have other legitimate reasons.

Any person who applies for renunciation of Chinese nationality shall lose

State functionaries and military personnel on active service shall not
- ]" H0 i& W. F+ p: krenounce Chinese nationality.# Z2 E. f7 g4 c
Article 13# K* b1 ~& J8 s
Foreign nationals who once held Chinese nationality may apply for
/ L) y# \$ l0 G+ G. O3 t l9 A, S2 _restoration of Chinese nationality if they have legitimate reasons; those
: A" C# U' C0 k" z6 Iwhose applications for restoration of Chinese nationality have been
8 J" |3 l0 k/ t/ `approved shall not retain foreign nationality. z$ s% i& A( V1 p8 T# w
Article 14
% Y$ H0 S! i0 Q2 Z8 _Persons who wish to acquire, renounce or restore Chinese nationality, with
3 A; t# `( X+ |- `5 |the exception of the cases provided for in Article 9, shall go through the3 l* g, w- s+ f3 X, B! e) t
formalities of application. Applications of persons under the age of 18( N: g, W( T% ?, g, k) a
may be filed on their behalf by their parents or other legal

Article 153 I9 q8 X' G, w
Nationality applications at home shall be handled by the public security. f: C, l) |. a! ]3 T
bureaus of the municipalities or counties where the applicants reside;
2 h/ Q0 w+ w V" _) cnationality applications abroad shall be handled by China''s diplomatic
, {: A; X, z; Y) d# [8 J& X% D' nrepresentative agencies and consular offices., u5 F! h4 A+ n [* C8 e. J
Article 16
$ A! y6 T1 G5 aApplications for naturalization as Chinese nationals and for renunciation6 e9 E- Q+ E2 S* z. S
or restoration of Chinese nationality are subject to examination and
- k( ~, A2 W' Capproval by the Ministry of Public Security of the People''s Republic of
7 h7 M+ J# y9 K9 |' r7 A; t2 lChina. The Ministry of Public Security shall issue a certificate to any: C, E# v6 @ N0 d9 ]$ ~8 h( O
person whose application has been approved.

The nationality status of persons who have acquired or lost Chinese
. Z- ]+ j/ d# N" Vnationality before the promulgation of this Law shall remain valid.

# g U5 x, r. W; ]0 Q% pThis Law shall come into force on the day of its promulgation. |
