《中华人民共和国国籍法》 ! }) `5 w4 x! ]2 p
  0 \3 W6 @& g1 e
第一条   中华人民共和国国籍的取得、丧失和恢复,都适用本法。
! W9 |( r8 w/ T+ G4 x1 n4 S0 u    第二条   中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。6 F4 f- ~4 y8 ~, Q# R
    第三条    中华人民共和国不承认中国公民具有双重国籍。9 A* a. Q" z5 L3 K7 E1 Z3 ]  g
    第四条   父母双方或一方为中国公民,本人出生在中国,具有中国国籍。
8 l" X  [: e  t. l7 N; G    第五条   父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。
9 j0 W, Z5 N9 ]- a    第六条   父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。$ L9 f, ^0 l% R1 O: L& p4 k
    第七条   外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:- a: X8 F6 o4 _; B; N
    一、中国人的近亲属;% d' q4 b& D9 i' W$ v8 M# i7 i
    二、定居在中国的;
. X+ S. P- x, Z4 f, h* g1 T, ?% b1 ]    三、有其它正当理由。  a" n6 i7 X4 }, x" r6 }
    第八条   申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。
6 ?3 q3 ]0 Z' G' Y: b9 K    第九条    定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。3 O7 l, N) }5 q* r9 i
    第十条    中国公民具有下列条件之一的,可以经申请批准退出中国国籍:* \; }/ R( k2 G+ w
    一、外国人的近亲属;
; y0 t, }% ~, K5 \, Q    二、定居在外国的;
  t1 _5 N/ Z/ p( r7 H    三、有其它正当理由。
+ _7 K( }* E. ?6 R  a7 q1 Q5 O9 `/ s    第十一条    申请退出中国国籍获得批准的,即丧失中国国籍。
, Y, K1 U5 j7 L% N- I/ T( ^    第十二条   国家工作人员和现役军人,不得退出中国国籍。7 S8 p3 B, L8 U$ W, w) P% |( |: A8 A( Q
    第十三条   曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。
8 {7 q, M" k% f4 I    第十四条   中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。/ t9 i/ e0 Z: ~* {. ~
    第十五条    受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。8 h+ X9 B: x: p/ i1 {
    第十六条   加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。( x: ^+ Z& x0 J
    第十七条   本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。

' T" z. w: e9 p) d  U3 eThis Law is  applicable  to  the  acquisition,  loss  and  restoration  of8 S: B0 |* T6 X
nationality of the People''s Republic of China.4 W3 X+ A/ S2 K' u# E6 @, T0 i
Article 2/ x6 h$ J  ?7 k5 }8 s
The People''s Republic of China is a unitary multinational  state;  persons  N/ \, F- E  }. Y
belonging to  any  of  the  nationalities  in  China  shall  have  Chinese, \5 h9 V- p! \
nationality.: S7 u- {1 `0 e3 `7 S; p$ P
Article 32 s0 v7 y6 e# k5 t5 N/ o( @: X  s
The People''s Republic of China does not recognize dual nationality for any
. [% P% p0 q+ G" H$ BChinese national.

Any person born in China whose parents are both Chinese nationals  or  one$ X1 t$ i3 [# F0 j% o
of whose parents is a Chinese national shall have Chinese nationality.
9 I# I5 i6 R9 g# o; A3 PArticle 5
- r2 q2 d+ a( `& |/ m( VAny person born abroad whose parents are both Chinese nationals or one  of
5 K8 y8 c" K4 a6 M$ nwhose parents is a Chinese national shall have Chinese nationality. But  a
+ c* y$ x* @; C8 ?6 n: @- Tperson whose parents are both Chinese  nationals  and  have  both  settled
8 u! f$ r" D: R" uabroad, or one of whose parents is a  Chinese  national  and  has  settled
: F7 T0 y7 t# j0 |9 Babroad, and who has acquired foreign nationality at birth shall  not  have) |* a0 q2 x, ?/ v! M* w. \# W
Chinese nationality.

! I. L$ T5 L" X5 [Any person born in China whose  parents  are  stateless  or  of  uncertain0 @- G3 H* s' D$ Y+ t( j1 \; _+ i
nationality and have settled in China shall have Chinese nationality.
, G/ U) l9 S! z) }1 gArticle 7) S, I) y! t. u: s$ Q
Foreign nationals or stateless persons who are willing to abide by China''s+ Q9 ]. O/ J  H3 P
Constitution and laws and who meet one of the following conditions may  be6 ?$ I" w2 G/ P7 A8 q
naturalized upon approval of their applications:3 d( {  g+ F/ ]/ H: U; @! B
(1) they are near relatives of Chinese nationals;! a) p5 W' r) s$ q
(2) they have settled in China; or$ T6 ~2 `: O' s, h
(3) they have other legitimate reasons.
2 O* l$ x9 P1 {" {- gArticle 82 [, \& B, P* F+ j* V# n  ]
Any person who applies for naturalization  as  a  Chinese  national  shall8 n; ?% N; `. W2 D
acquire Chinese nationality upon approval of  his  application;  a  person
* `  W  H4 O2 d0 p# b* N" ewhose application for  naturalization  as  a  Chinese  national  has  been# h' e- r1 @/ u, ?( m1 [" M
approved shall not retain foreign nationality.' I8 E( y* s( a4 s4 v4 V2 [$ }
Article 9) M# x- l4 ?7 X7 ], s8 G
Any Chinese national who has settled abroad and who has  been  naturalized' C9 q, @2 J* r' U8 ]
as a foreign national or has acquired foreign nationality of his own  free
& q* M: B; F: }+ Dwill shall automatically lose Chinese nationality.# d& e8 o2 e  [
Article 10
) i# x5 _- J# D& H5 c; F0 ?Chinese nationals who meet one of the following  conditions  may  renounce
% a2 Z% y& L2 O9 z; W7 a6 F/ fChinese nationality upon approval of their applications:
- d. ], u0 f9 K) j(1) they are near relatives of foreign nationals;
# [) I6 }3 o2 ?1 ?8 w6 ^(2) they have settled abroad; or. \! z, S* u" u9 N# A
(3) they have other legitimate reasons.  i% E3 ~$ ]) P) x
Article 11) H1 k) S9 _: {. W
Any person who applies for renunciation of Chinese nationality shall  lose% r! G; y3 {) ]( U% x
Chinese nationality upon approval of his application.
' ]0 y4 b4 e% C1 {, I8 S$ S/ {Article 12" S( p) r# ^/ f, |( X
State functionaries and military personnel on  active  service  shall  not* _+ w. u5 U6 w7 h4 P% t- n9 }
renounce Chinese nationality.4 g; @/ |/ a" H
Article 13
. p9 b8 s" ]! Y/ `Foreign  nationals  who  once  held  Chinese  nationality  may  apply  for" j: Y3 W* W" C$ R
restoration of Chinese nationality if they have legitimate reasons;  those. |; X5 b8 [% a6 t# @' F. v# F
whose applications  for  restoration  of  Chinese  nationality  have  been
! a& F" k3 {. qapproved shall not retain foreign nationality.  A5 |% B* T6 S
Article 14
4 Y/ ^6 \3 j: H( |9 k3 E8 d$ kPersons who wish to acquire, renounce or restore Chinese nationality, with
( H+ v8 E% v; o1 Y7 N# |the exception of the cases provided for in Article 9, shall go through the
: U* ?! ~% h3 _. ?formalities of application.  Applications of persons under the age  of  18# g) N3 m; K1 @
may  be  filed  on  their  behalf  by  their  parents   or   other   legal
) h; A# g$ X4 o! X' }/ v1 Srepresentatives.6 F1 B: E9 i. v: |
Article 15" G9 \8 M* T( a. F
Nationality applications at home shall be handled by the  public  security5 u3 f& d' U- q" m
bureaus of the municipalities or counties where the applicants reside;
/ W) c) m: j4 ^) B" }5 jnationality applications abroad shall be  handled  by  China''s  diplomatic
: J5 E) C) s/ e' H! `7 brepresentative agencies and consular offices.3 r" u" g5 h2 ~. C2 o$ q8 U
Article 16  {6 P" B1 \. s* B* s
Applications for naturalization as Chinese nationals and for  renunciation
* l: W- c5 e# {5 ?1 Y' C- Tor restoration of Chinese  nationality  are  subject  to  examination  and4 ^6 }' @8 S$ P/ b* T
approval by the Ministry of Public Security of the  People''s  Republic  of
2 @& c+ k1 L4 ^0 Q0 o5 u5 w' _China. The Ministry of Public Security shall issue a  certificate  to  any
  m' k; Y2 O) C5 y$ k4 Zperson whose application has been approved.& _1 X, \7 ~) w+ P* W' b
Article 17( I2 A0 @0 {( T% z9 R/ G
The nationality status of  persons  who  have  acquired  or  lost  Chinese
$ I) n' |2 h/ i/ n" `! gnationality before the promulgation of this Law shall remain valid.
8 B  J3 }. B# h. Q  ~: AArticle 18
( G. {6 i4 [' P0 u1 hThis Law shall come into force on the day of its promulgation.
