1 S1 s6 `0 j. E, w% r& I2 H 第一条   中华人民共和国国籍的取得、丧失和恢复,都适用本法。! m' F8 P. Y5 }+ _, ]" a
    第二条   中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。/ K1 j9 M0 @. h( z$ D6 \  g
    第三条    中华人民共和国不承认中国公民具有双重国籍。3 O( W* z! O1 w
    第四条   父母双方或一方为中国公民,本人出生在中国,具有中国国籍。
9 v+ ^  n# |7 ]$ H) a& G    第五条   父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。
& N+ U% u' O. D9 t3 ^    第六条   父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。
' b6 l, D6 `+ _8 S2 n    第七条   外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:) F! }9 U/ D  h2 X
    一、中国人的近亲属;
4 y1 `; m: t. X& ~. F    二、定居在中国的;
+ e/ V! [- t& ]% i1 ~. Z    三、有其它正当理由。
2 ?' H" m6 X9 u2 L  f* D, l5 `    第八条   申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。
; j, ?* G* Q3 s( v4 i    第九条    定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。" {5 E* ]) r1 s( W7 N! Z# g' g( y
    第十条    中国公民具有下列条件之一的,可以经申请批准退出中国国籍:
: ^" c, D$ X- s) |6 a( u8 w    一、外国人的近亲属;
4 w; o) j) P9 D5 R: x+ P    二、定居在外国的;( d" _7 o2 w: @6 X
    三、有其它正当理由。% `" y6 P( H7 ^
    第十一条    申请退出中国国籍获得批准的,即丧失中国国籍。  }0 X; r6 w6 y) T' `  e
    第十二条   国家工作人员和现役军人,不得退出中国国籍。: l: h9 r6 A% v# i
    第十三条   曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。" m- {- P! C: P% o
    第十四条   中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。
0 e0 G( Z) Z/ Q) K0 H# l    第十五条    受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。
; w7 E4 Z' x) |/ T$ f, h8 D    第十六条   加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。
) h4 f5 N! Z; K7 m2 }' J    第十七条   本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。7 h- X/ a/ c: T2 {+ Y3 W

7 y  a& R3 ^6 M. J/ N7 U7 P" OThis Law is  applicable  to  the  acquisition,  loss  and  restoration  of
- |' `; R+ t1 B/ `% Unationality of the People''s Republic of China.* E6 W' n% G% g
Article 2
# r3 w- V  E5 m3 ZThe People''s Republic of China is a unitary multinational  state;  persons) n/ f+ ]# x9 c6 C4 d4 I: i
belonging to  any  of  the  nationalities  in  China  shall  have  Chinese
+ i" C6 K( {2 L/ hnationality." b5 D. C, n5 q
Article 3- Z; I2 v, V+ p. |1 `8 J7 }8 d
The People''s Republic of China does not recognize dual nationality for any; s& K: O) V+ |8 ~: K# t
Chinese national.
2 ]' N, }6 r: n( g9 p' A9 Q8 pArticle 4# V. g9 P# P; c
Any person born in China whose parents are both Chinese nationals  or  one$ B7 R# Z8 w) g
of whose parents is a Chinese national shall have Chinese nationality.. T" N$ E+ n# M, x: \: ^; O7 N  E
Article 5
& d% ^) V$ f+ S. s; uAny person born abroad whose parents are both Chinese nationals or one  of- J8 y0 ~( `4 z, P8 w
whose parents is a Chinese national shall have Chinese nationality. But  a
8 R. |2 u: l( d. T; R5 H1 Xperson whose parents are both Chinese  nationals  and  have  both  settled
0 ]' i5 w8 A. K6 Oabroad, or one of whose parents is a  Chinese  national  and  has  settled
1 X/ E1 _3 H+ ]( U0 |, Babroad, and who has acquired foreign nationality at birth shall  not  have" h5 X& W" U& L0 I
Chinese nationality.
# J, y" s: j2 R9 B4 a) ^* w9 XArticle 6
  ^# H- n, U# i& F. TAny person born in China whose  parents  are  stateless  or  of  uncertain
" i( L5 n  {9 ]( lnationality and have settled in China shall have Chinese nationality.( E. @' ?! e0 _% d: _& u) G. U
Article 7
  c/ G( m+ A" N- L& k# nForeign nationals or stateless persons who are willing to abide by China''s. [+ E4 _0 c4 Q
Constitution and laws and who meet one of the following conditions may  be
% W# v% u1 ], q, f0 Vnaturalized upon approval of their applications:
. n# R' A* p5 C( ]; J7 Y(1) they are near relatives of Chinese nationals;
* U, ]1 \3 r! m4 c6 N(2) they have settled in China; or5 i' Q  Y, H+ K; R
(3) they have other legitimate reasons.
/ a* p' X* p  o) M7 X( dArticle 8" U6 Y( W# z" G, ~5 K2 |
Any person who applies for naturalization  as  a  Chinese  national  shall. u% q* R, ~* r1 a5 V3 I
acquire Chinese nationality upon approval of  his  application;  a  person+ s0 k+ n& ]$ [7 C
whose application for  naturalization  as  a  Chinese  national  has  been7 @; q, i% k; H, M
approved shall not retain foreign nationality.
) `6 C' V* q) Z  |4 u  VArticle 93 Z. f+ Z2 S/ B) c0 q/ |* g+ \
Any Chinese national who has settled abroad and who has  been  naturalized
: g8 I; L) D7 T4 a8 A; ^as a foreign national or has acquired foreign nationality of his own  free
* U+ r; B+ U: a( nwill shall automatically lose Chinese nationality.
% c# K$ K/ y, o' O: }1 YArticle 105 _! b3 }8 c6 ^$ ~2 P$ z" P# n
Chinese nationals who meet one of the following  conditions  may  renounce' d" D% ^1 W! r# i
Chinese nationality upon approval of their applications:
& \1 R( ~# Z4 q(1) they are near relatives of foreign nationals;1 H* L5 e) h; k
(2) they have settled abroad; or5 b: o8 Z) k: c2 p& y
(3) they have other legitimate reasons.
8 p$ J2 y( K3 W' p" D2 }Article 11
5 d4 m( t" R+ @  E9 k5 C. F+ lAny person who applies for renunciation of Chinese nationality shall  lose9 w4 V$ B1 V, q1 B7 W- R! J$ {
Chinese nationality upon approval of his application.
  ?6 H/ z# f6 hArticle 12
, g8 {6 K7 T' k, ]State functionaries and military personnel on  active  service  shall  not
% W" y( g2 Y+ m) Q9 R9 z/ |renounce Chinese nationality.
1 Z5 ]9 x7 `& h$ H  XArticle 13
$ I3 _" B" U: }; V+ t4 m9 p+ nForeign  nationals  who  once  held  Chinese  nationality  may  apply  for- s2 L1 {* ?8 m; H
restoration of Chinese nationality if they have legitimate reasons;  those
5 l4 j# m4 d# R8 e0 n2 f/ y- nwhose applications  for  restoration  of  Chinese  nationality  have  been: A7 `; l4 ^, n/ I$ J( _! s! x' n2 d
approved shall not retain foreign nationality.
3 U! K) x' O* w* j2 q: lArticle 146 F4 T3 @4 g" d0 W$ g
Persons who wish to acquire, renounce or restore Chinese nationality, with
6 V* v7 b! e+ ~$ z. a* @% Bthe exception of the cases provided for in Article 9, shall go through the
0 F3 ^; W6 ]$ G, ]; M9 q+ Qformalities of application.  Applications of persons under the age  of  18
( Z) X/ X# N9 `2 M( O$ Pmay  be  filed  on  their  behalf  by  their  parents   or   other   legal8 R: a: t6 t! b( ^! d: s6 n
representatives.5 T3 g4 m9 h! M  g- S" a$ c
Article 15
' e8 p) A8 J  V# dNationality applications at home shall be handled by the  public  security
7 X0 a7 C0 C: T( W' N0 qbureaus of the municipalities or counties where the applicants reside;9 f' U, o0 H% F0 F- a
nationality applications abroad shall be  handled  by  China''s  diplomatic
+ I3 Y5 K  p+ ~$ [representative agencies and consular offices.
% E# v' J; i8 T$ A4 AArticle 16
9 A& z+ O+ O$ U/ ]4 B2 f" oApplications for naturalization as Chinese nationals and for  renunciation
2 p3 L0 l+ d- h; f/ f2 r! yor restoration of Chinese  nationality  are  subject  to  examination  and! V/ H0 l" d6 A9 G- Z6 L
approval by the Ministry of Public Security of the  People''s  Republic  of
+ Z- y) k5 |9 a4 KChina. The Ministry of Public Security shall issue a  certificate  to  any( p% N8 t* O! A+ \" g3 u0 I) L
person whose application has been approved.
: g; X7 p: Y( O/ K( vArticle 17
" s/ L" V% S& [, P, B) D. y' cThe nationality status of  persons  who  have  acquired  or  lost  Chinese
. z0 \5 O' m" e& unationality before the promulgation of this Law shall remain valid.1 M# k+ X8 }' t& S5 U( a* ^
Article 18
( U$ Q! U( V1 d/ f) [This Law shall come into force on the day of its promulgation.
