《中华人民共和国国籍法》 $ B7 V! Y6 D( s
 
% n- \) D4 {+ X5 D$ Z2 O 第一条   中华人民共和国国籍的取得、丧失和恢复,都适用本法。7 r6 x( u4 u4 `+ n  q
    第二条   中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。8 G7 h% B# f( Q
    第三条    中华人民共和国不承认中国公民具有双重国籍。
. f! O  l% W8 J! w9 r" M    第四条   父母双方或一方为中国公民,本人出生在中国,具有中国国籍。
4 E1 |! {9 Q5 K2 k5 I9 R; c    第五条   父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。
; H8 }  k) {' N, R    第六条   父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。5 ^% I! Z* m* s; I1 x
    第七条   外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:

    二、定居在中国的;
/ v1 j. r9 y/ ?* B; x/ Y    三、有其它正当理由。3 ?2 ~) A) _, L: B
    第八条   申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。
' W/ U3 K. H' K+ t  p    第九条    定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。+ U" u8 R( d0 _  ~2 \
    第十条    中国公民具有下列条件之一的,可以经申请批准退出中国国籍:. u* Z% L. c9 ?
    一、外国人的近亲属;
! O6 D' L. Z$ m) Q$ e3 d4 ], |    二、定居在外国的;
: e/ |( L( Q; m    三、有其它正当理由。
( @( ~+ w' y* ^' `    第十一条    申请退出中国国籍获得批准的,即丧失中国国籍。! D: X7 M: H) o
    第十二条   国家工作人员和现役军人,不得退出中国国籍。; w- y  \' U3 ^
    第十三条   曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。- ?% Q0 W1 X5 T) C& a7 W$ n* s
    第十四条   中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。
  a8 A& v+ U8 o3 Y/ h3 u    第十五条    受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。" ~" [' N# O: g. g$ b7 S+ v- C
    第十六条   加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。

7 U" t& ]' y( e# P6 ^$ G( KCommittee of the  National  People''s  Congress  on  and  effective  as  of

Article 1
+ R; r, ~1 P9 B; f! A$ L. ^This Law is  applicable  to  the  acquisition,  loss  and  restoration  of# O  Q5 R9 U  b: R+ f
nationality of the People''s Republic of China.
1 ]8 ^/ r$ K7 w8 J- @1 wArticle 2
/ r1 i' p/ F7 h* x# v; ~The People''s Republic of China is a unitary multinational  state;  persons
; b, }7 Q; g2 S( Vbelonging to  any  of  the  nationalities  in  China  shall  have  Chinese
  B) ~, X) ^' t4 i) l2 y& M% Lnationality.3 P" y7 V' m3 t; g
Article 3
4 t  v' b3 W( d2 MThe People''s Republic of China does not recognize dual nationality for any- W0 w1 \  q* {2 ]+ [! R' S
Chinese national.  Z9 q, S. x! x
Article 4
7 \$ ]' D/ f. ?! ~6 |2 d3 kAny person born in China whose parents are both Chinese nationals  or  one
! W! W: W1 e! G6 oof whose parents is a Chinese national shall have Chinese nationality.7 I# G, @. w; r8 F8 j( {% _0 A
Article 51 i* [6 w! {: ^
Any person born abroad whose parents are both Chinese nationals or one  of3 a- b* J- R* A% i, h
whose parents is a Chinese national shall have Chinese nationality. But  a
6 l- Z4 c/ u( k# l2 }4 o/ Qperson whose parents are both Chinese  nationals  and  have  both  settled
5 o, j: U- t! Iabroad, or one of whose parents is a  Chinese  national  and  has  settled. O8 `' L; G* b
abroad, and who has acquired foreign nationality at birth shall  not  have
/ M: i) L) w) x' nChinese nationality.* h- `) k4 W3 b4 _6 ]/ T# m: B
Article 66 ^: S& J# @$ m+ h
Any person born in China whose  parents  are  stateless  or  of  uncertain
; O. _& T! n2 D6 h, C) g( ?nationality and have settled in China shall have Chinese nationality.
* \. {' @- m6 L7 iArticle 7
. u; Z2 G9 t1 h8 wForeign nationals or stateless persons who are willing to abide by China''s+ `: M1 r8 d" m3 W0 G1 X
Constitution and laws and who meet one of the following conditions may  be9 V# L, \' l7 z+ q' B
naturalized upon approval of their applications:
  G* p& }5 `4 X  I4 L6 _# i(1) they are near relatives of Chinese nationals;
& Z. p1 l$ X% j$ e  }(2) they have settled in China; or
4 c0 g. K# [6 d/ S6 g/ ?# K, ^(3) they have other legitimate reasons., f# m1 g0 W9 |: J5 C6 `9 j# ?
Article 85 D% N+ E: e+ Z( \- @
Any person who applies for naturalization  as  a  Chinese  national  shall$ h, d( u5 `* b( d1 y9 x
acquire Chinese nationality upon approval of  his  application;  a  person( d, v5 i; D$ ~, s
whose application for  naturalization  as  a  Chinese  national  has  been8 ?3 B0 p5 J+ Q
approved shall not retain foreign nationality.& v% V  ~( t& M7 e0 O7 k- b% i' X6 F
Article 99 `6 m& P/ L1 z, ^0 }) j5 s5 ^
Any Chinese national who has settled abroad and who has  been  naturalized
2 u# e0 r* W* h# E  bas a foreign national or has acquired foreign nationality of his own  free
2 N8 M- w0 l3 R: ~# }will shall automatically lose Chinese nationality.) d; x/ t7 n' r( ^) a, v" I9 D
Article 10
. a, @' a; y" F2 \Chinese nationals who meet one of the following  conditions  may  renounce
9 g) y+ F  h* P  f; W/ @$ lChinese nationality upon approval of their applications:% j) o  [% @* K6 Q0 o4 z
(1) they are near relatives of foreign nationals;5 ?3 ]' B( w; z4 l
(2) they have settled abroad; or
+ i2 c* t* o" I6 @% g* k) i. z(3) they have other legitimate reasons." K1 s. M" l2 h8 P7 `/ r0 ?
Article 110 r# X+ |! @- W5 v! I
Any person who applies for renunciation of Chinese nationality shall  lose$ |/ W# W" @5 i- D: m
Chinese nationality upon approval of his application.
3 B. U/ [+ \% E" HArticle 12
' H0 E* Y/ ]& @6 a2 IState functionaries and military personnel on  active  service  shall  not
  {* R6 t" S4 w  S8 l1 xrenounce Chinese nationality.( N% s6 m8 z7 R( G: F/ n
Article 13
2 |% K1 R& _0 `0 y  tForeign  nationals  who  once  held  Chinese  nationality  may  apply  for* W) x; ~" u4 E6 S4 ~
restoration of Chinese nationality if they have legitimate reasons;  those
0 l. S) [6 y( X- e% jwhose applications  for  restoration  of  Chinese  nationality  have  been2 u" @/ b1 f0 o  Y% y
approved shall not retain foreign nationality.! n. X, i9 R5 P! V$ E; @* `
Article 14
6 ~; K% Y$ _7 O$ S0 FPersons who wish to acquire, renounce or restore Chinese nationality, with
# b2 |0 ^( k9 X  R9 z: \  Hthe exception of the cases provided for in Article 9, shall go through the
1 \: z1 |& f. H2 Pformalities of application.  Applications of persons under the age  of  18' u* [4 n/ B  {# W1 E2 r
may  be  filed  on  their  behalf  by  their  parents   or   other   legal" Q& J& S4 {% Z) q$ ?
representatives.9 s  ?3 Z1 B* X  X/ _* |
Article 15
  v4 _. [" X' zNationality applications at home shall be handled by the  public  security( i' d6 |9 W" r/ @& I* H, f# E/ Z
bureaus of the municipalities or counties where the applicants reside;- t% I$ O9 T1 b7 Z, w/ m' }( D
nationality applications abroad shall be  handled  by  China''s  diplomatic
+ ]1 M- Z, N6 A) S1 E, Lrepresentative agencies and consular offices.
1 A2 S4 O" r; [* z3 l1 ?& r& [. PArticle 16
$ |' Y/ Z/ a1 V+ J# |4 wApplications for naturalization as Chinese nationals and for  renunciation* R( v' `3 H7 F* I) G, y. Z* N
or restoration of Chinese  nationality  are  subject  to  examination  and+ `; m1 t2 o% \" b
approval by the Ministry of Public Security of the  People''s  Republic  of- O0 x" y4 C2 Q
China. The Ministry of Public Security shall issue a  certificate  to  any* U3 X/ J- w# Z( t! D! v
person whose application has been approved.% F3 ^) q0 r0 x- [* Z4 i8 J9 ]
Article 17
+ w' I3 u* D) \( Q3 s& [& E4 RThe nationality status of  persons  who  have  acquired  or  lost  Chinese( T) k% C' @, Q8 O/ X% V+ x
nationality before the promulgation of this Law shall remain valid.
) w/ q9 G% q+ z8 h- m1 N) j, NArticle 18
0 n% H( C* r9 k  M9 |+ C8 OThis Law shall come into force on the day of its promulgation.
