第一条   中华人民共和国国籍的取得、丧失和恢复,都适用本法。
" x3 O' x7 k+ u0 X. Z    第二条   中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。5 j; e  L+ k; Q
    第三条    中华人民共和国不承认中国公民具有双重国籍。: u- f- W4 |: ?- `' k. k* ?  c
    第四条   父母双方或一方为中国公民,本人出生在中国,具有中国国籍。7 Z; |% o/ w% `2 S/ ?" D9 D, y
    第五条   父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。
( m( z' ]. f/ `5 o7 y    第六条   父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。) I0 _5 P: D. O+ S/ ~; m' _) V9 q$ ^
    第七条   外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:/ O; Z8 K; N0 s7 P/ X+ \
    一、中国人的近亲属;
% |. o$ x$ m2 N7 V    二、定居在中国的;
6 X& N$ A( j+ d8 t3 S    三、有其它正当理由。4 V& @1 j2 z& k8 W3 J3 r, f5 \
    第八条   申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。
, {/ m+ L7 x) Y: p, s    第九条    定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。
& v5 `" B) [7 ^    第十条    中国公民具有下列条件之一的,可以经申请批准退出中国国籍:
& c; C4 @# i* }1 t, S$ U" @+ C1 C    一、外国人的近亲属;; n8 ]& ~+ u. Y% ~( }
    二、定居在外国的;) {6 W7 _- L: v1 r2 _2 @% F* t: G' V
    三、有其它正当理由。0 D5 I! m, s  }1 |+ d
    第十一条    申请退出中国国籍获得批准的,即丧失中国国籍。
) {; a. d* k& V# P    第十二条   国家工作人员和现役军人,不得退出中国国籍。4 U" I" p/ F! F$ ^% ]* ?; U( t
    第十三条   曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。
# I: E/ y; O% E' O6 d* q6 |) D    第十四条   中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。
, k  c- b" h  b2 p    第十五条    受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。. W$ E$ a. M. ~- G
    第十六条   加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。( R4 ~  [# b: w2 n; m0 b
    第十七条   本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。0 j7 v( E0 G7 V# w
    第十八条   本法自公布之日起施行。: h6 I5 s- a! b) x7 S% ]7 {

This Law is  applicable  to  the  acquisition,  loss  and  restoration  of
" X9 m- O& Y8 Rnationality of the People''s Republic of China.
3 Q  S' f, b# c9 G7 HArticle 2+ g; ]8 J) {1 P5 f, q
The People''s Republic of China is a unitary multinational  state;  persons2 k5 Z- ?. g1 E' P
belonging to  any  of  the  nationalities  in  China  shall  have  Chinese, h% w$ Y: k+ C* O
nationality.1 \" Q7 |; [  _5 b3 ~% ?' J0 E
Article 3
' v$ g8 Q7 I+ [; b1 p/ Y" M6 z$ tThe People''s Republic of China does not recognize dual nationality for any
: ]3 p5 r9 D; l1 ^2 rChinese national.% t- n. g# X/ l" @  i2 M. i
Article 4
: s/ S. o( v# G$ U0 YAny person born in China whose parents are both Chinese nationals  or  one* a, B( T% w( o* T
of whose parents is a Chinese national shall have Chinese nationality." S* f+ B7 J2 H" J( B
Article 5$ f0 b% Q* U! H4 e
Any person born abroad whose parents are both Chinese nationals or one  of
5 i; P6 @  C9 t8 ]5 Vwhose parents is a Chinese national shall have Chinese nationality. But  a- f; ?5 g( Y: m, S! o  ~% O' N
person whose parents are both Chinese  nationals  and  have  both  settled
1 u# j7 o# X) mabroad, or one of whose parents is a  Chinese  national  and  has  settled
/ z" {: r  P' y" o8 U! K( Mabroad, and who has acquired foreign nationality at birth shall  not  have
  I4 I' g* H/ ZChinese nationality.+ l  X% S2 Y& i: |
Article 6
* \& E( s9 w8 ~' A9 e. ~" l- dAny person born in China whose  parents  are  stateless  or  of  uncertain
3 ?  a4 i; x# L6 o" Knationality and have settled in China shall have Chinese nationality.
. n7 |4 }7 }  q0 C4 FArticle 7
5 E* E, y7 V2 J+ @7 {- wForeign nationals or stateless persons who are willing to abide by China''s/ w) ?+ n  T' g) S1 f9 r8 e
Constitution and laws and who meet one of the following conditions may  be5 k; y: A" M2 j$ n
naturalized upon approval of their applications:
6 ^/ I" G6 B8 Z1 V8 s0 }3 f(1) they are near relatives of Chinese nationals;3 U7 o! H; P. d; B, q) s9 d  b; Z
(2) they have settled in China; or6 g! v8 a1 r/ w( k
(3) they have other legitimate reasons.8 D* }, R/ {' s- f
Article 8
. o2 L; u* q0 ^- I9 lAny person who applies for naturalization  as  a  Chinese  national  shall
: @0 t. v; b9 G+ zacquire Chinese nationality upon approval of  his  application;  a  person
7 ?2 m! q7 Q1 R3 ?$ j9 i( i/ mwhose application for  naturalization  as  a  Chinese  national  has  been
8 b  R. [4 M- S( U9 b1 i' l# tapproved shall not retain foreign nationality.4 T5 P" ^! f  p1 Q- a  t
Article 9
8 ^/ y6 w3 a, I  P0 NAny Chinese national who has settled abroad and who has  been  naturalized
2 V" n: |5 k. t2 N. o2 \8 Ias a foreign national or has acquired foreign nationality of his own  free
2 v6 D0 f& l8 D+ K3 Qwill shall automatically lose Chinese nationality.
2 u' ?, O" E) H7 H8 R1 f% t$ fArticle 102 T& w9 I% R: ]6 w6 Q2 K, {# P0 t
Chinese nationals who meet one of the following  conditions  may  renounce
) V- Q% B/ u$ o, p/ r. lChinese nationality upon approval of their applications:
! {2 y; ~3 {; N& `(1) they are near relatives of foreign nationals;
  _- j& \: w3 C: [3 O% \  W9 c, G7 V. ](2) they have settled abroad; or
3 M, }. E' u4 V- x(3) they have other legitimate reasons.3 w1 ?) ^/ N3 l0 f4 P" o8 A
Article 11
( b' [, _! D; M" `* x; ?4 U& z6 QAny person who applies for renunciation of Chinese nationality shall  lose7 p1 O) Z# l2 E0 I/ |2 _/ F1 A
Chinese nationality upon approval of his application.
1 R2 _  H( i, P0 |' XArticle 12! |, s% u) Y: Z$ f
State functionaries and military personnel on  active  service  shall  not
/ h& j2 N' Z- f* xrenounce Chinese nationality.& B& O2 o2 i+ m2 b) N" Y6 }
Article 13
* U4 B5 b- h) x% L9 W: W+ H& A( TForeign  nationals  who  once  held  Chinese  nationality  may  apply  for
* |( O8 v% Q+ E! _9 lrestoration of Chinese nationality if they have legitimate reasons;  those# Y& P# |0 h7 o/ u
whose applications  for  restoration  of  Chinese  nationality  have  been
& C& ~. ^$ ?$ ]: ~( G5 W6 o) D# {approved shall not retain foreign nationality.
0 J. A1 f8 I: f! E+ E/ u  oArticle 14) g) j$ N' r! i) _0 Z6 F
Persons who wish to acquire, renounce or restore Chinese nationality, with; I  a4 J$ k& @) D" R$ w6 M  ~
the exception of the cases provided for in Article 9, shall go through the
3 C1 G) I, G, o% K5 `6 k5 y7 mformalities of application.  Applications of persons under the age  of  185 ]6 B% d! T5 n) K9 U
may  be  filed  on  their  behalf  by  their  parents   or   other   legal. D+ n: q/ A, _1 ^; s% W
representatives.2 `+ k/ _+ u. K7 @, q; Y
Article 158 t! X- P. [8 Y/ _
Nationality applications at home shall be handled by the  public  security. u! Y4 g! I3 D, f7 S# Z
bureaus of the municipalities or counties where the applicants reside;! ^8 y) o- `* i. S& b' H4 _
nationality applications abroad shall be  handled  by  China''s  diplomatic
* }% B  k9 {5 I3 grepresentative agencies and consular offices.* A- K5 X' S4 Q5 F* B; s% V3 Q7 R
Article 167 o! P0 }' E2 A
Applications for naturalization as Chinese nationals and for  renunciation
- G! E2 O* R- Y$ p4 |or restoration of Chinese  nationality  are  subject  to  examination  and2 ^$ i$ h" m1 \* m
approval by the Ministry of Public Security of the  People''s  Republic  of, \) T5 _7 ^& J8 c  y6 w
China. The Ministry of Public Security shall issue a  certificate  to  any
8 I' Z' _' r) z: k6 @$ |' Sperson whose application has been approved.2 {3 }, J# C0 T' W' N4 Y- S
Article 17
5 X$ `9 S* r* P' Q3 d- p/ ^The nationality status of  persons  who  have  acquired  or  lost  Chinese) ?# _! A2 @9 M
nationality before the promulgation of this Law shall remain valid.$ L2 p) b' v$ v
Article 186 Z9 s  V2 N- [0 @) N
This Law shall come into force on the day of its promulgation.
