《中华人民共和国国籍法》

第一条   中华人民共和国国籍的取得、丧失和恢复,都适用本法。( P, x- n, e5 c! U: ]% j
    第二条   中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。- H* f! W( s8 F. @
    第三条    中华人民共和国不承认中国公民具有双重国籍。1 t3 x2 o/ {1 H+ n
    第四条   父母双方或一方为中国公民,本人出生在中国,具有中国国籍。
' a9 m3 H, C" g& k$ s4 W4 [    第五条   父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。. P; G( \1 x( m* Z% d
    第六条   父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。3 \1 E( }6 r+ L  d
    第七条   外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:: j1 k1 H+ w3 m
    一、中国人的近亲属;& s+ G) S- o2 i3 M, _. d, J
    二、定居在中国的;
$ b7 W3 h' Z8 ~    三、有其它正当理由。' ?5 F5 U6 C: `
    第八条   申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。
) _1 Y. c; G" Y  X  t1 {* L& O    第九条    定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。
( U) i+ P0 q6 b) g+ ]3 p1 Q    第十条    中国公民具有下列条件之一的,可以经申请批准退出中国国籍:
" O! O/ ]$ T0 y$ F3 x. m    一、外国人的近亲属;! m' i# Z+ R2 J
    二、定居在外国的;
5 y% _6 n$ ~  F  J* G0 N    三、有其它正当理由。3 U# H9 t8 ^& o! Q5 Z
    第十一条    申请退出中国国籍获得批准的,即丧失中国国籍。& H7 h4 G0 B( L$ q
    第十二条   国家工作人员和现役军人,不得退出中国国籍。
0 T5 ?* P, O% T    第十三条   曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。& f* D* d2 O; h, R
    第十四条   中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。
  e, n# {' I% ^6 {, y    第十五条    受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。
0 A  r4 f- R$ N! u8 A4 |$ ~+ e    第十六条   加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。

This Law is  applicable  to  the  acquisition,  loss  and  restoration  of
3 ?2 K$ e4 x) _7 anationality of the People''s Republic of China.
) k0 O) M7 |6 W5 [; C) ]/ zArticle 20 u. N* ^# G9 V
The People''s Republic of China is a unitary multinational  state;  persons
6 I* {, u7 A+ J  Xbelonging to  any  of  the  nationalities  in  China  shall  have  Chinese
9 h/ \2 d) g* e2 ?1 ^0 g% f1 wnationality.
$ \8 [! R7 p6 Y/ M& [Article 3
* j/ X: y& b2 Z7 z9 iThe People''s Republic of China does not recognize dual nationality for any
* {% Y; t. Z! y# _: \% iChinese national.1 ]' H' B6 N* }7 N
Article 4
- m9 ?2 D; }4 w/ Z; kAny person born in China whose parents are both Chinese nationals  or  one. c' k$ J# t; \: q5 D
of whose parents is a Chinese national shall have Chinese nationality.
8 i1 O6 Y) B# dArticle 5
3 }7 O. U# R' E3 v% y0 uAny person born abroad whose parents are both Chinese nationals or one  of
* S! N4 r3 S- b1 l% Awhose parents is a Chinese national shall have Chinese nationality. But  a) m9 I( M# v& |2 C" K, D8 h- I( \( y
person whose parents are both Chinese  nationals  and  have  both  settled
. W- o( h' B$ h1 e& q6 \abroad, or one of whose parents is a  Chinese  national  and  has  settled: x: o% ?0 |7 Y8 Z+ k* N
abroad, and who has acquired foreign nationality at birth shall  not  have: u. j9 P  g9 a$ `/ {. t
Chinese nationality.
* @1 A, h0 t9 CArticle 6: o: o# Q- A% r
Any person born in China whose  parents  are  stateless  or  of  uncertain: J* l/ X/ y) S* O- E" Y+ w  Q& S
nationality and have settled in China shall have Chinese nationality.5 V, l' V# C8 X! r7 O2 `% q/ R
Article 7
! O- ?  T( ]# Q  r: f$ T# vForeign nationals or stateless persons who are willing to abide by China''s
  v# k- G3 T; L4 U" S: ?Constitution and laws and who meet one of the following conditions may  be
3 D* f# _6 S* G- i( V" g$ jnaturalized upon approval of their applications:
$ \5 G# q# n2 A+ N$ m: |(1) they are near relatives of Chinese nationals;
: ]0 n+ B8 w1 F- e; m% s+ m(2) they have settled in China; or$ ]5 a+ N& _, Y# s+ }6 `! i6 u
(3) they have other legitimate reasons.: B# L7 v+ k  t9 Y5 _
Article 8
4 B' Q+ ]4 A& \0 YAny person who applies for naturalization  as  a  Chinese  national  shall6 K$ k, I. A1 f* {5 B
acquire Chinese nationality upon approval of  his  application;  a  person, `; V- [+ d! _- i  L
whose application for  naturalization  as  a  Chinese  national  has  been
+ P% K9 E6 P- H; N7 @& qapproved shall not retain foreign nationality.! l. {5 U; L; T, ~1 }: Q& X0 l. R4 ~
Article 9; M; d2 E8 C! G
Any Chinese national who has settled abroad and who has  been  naturalized" T2 i2 O6 {0 C! a5 q6 Y
as a foreign national or has acquired foreign nationality of his own  free# C) O6 p- I1 V( i8 C
will shall automatically lose Chinese nationality., A, u' l( W' B  U& K
Article 10
8 X1 {0 y- @/ |$ q. _Chinese nationals who meet one of the following  conditions  may  renounce
2 q6 }9 ^: U* ]) |$ ~- ]& d$ Y- jChinese nationality upon approval of their applications:
& d0 s% j( o- r( T2 Q7 I, _  T5 L(1) they are near relatives of foreign nationals;
( c4 s" ~" [' z- {  d) }(2) they have settled abroad; or# ^4 Q( [: Q  W( a/ B+ {' ?
(3) they have other legitimate reasons.3 X" }- I1 n$ }+ U. x: k
Article 119 B# X8 E5 J/ r1 S$ ^/ A
Any person who applies for renunciation of Chinese nationality shall  lose
; m8 H; v8 @8 t: V: WChinese nationality upon approval of his application." A( O% c# T: b; f* p- O, U
Article 12% x, r! g5 }5 H! F
State functionaries and military personnel on  active  service  shall  not. q" y) c. e, Y
renounce Chinese nationality.
# T9 a0 d4 w, a8 J4 L4 Y% g! dArticle 13
8 ^! p$ [. P& ~* JForeign  nationals  who  once  held  Chinese  nationality  may  apply  for
$ X9 d; y& J2 L% N' n% f) Drestoration of Chinese nationality if they have legitimate reasons;  those% b' X& {: ^" T
whose applications  for  restoration  of  Chinese  nationality  have  been
& [" R8 `" Q( Bapproved shall not retain foreign nationality.& P, n& L! W1 N- j& |+ P' @$ Q- _5 i! C
Article 14
' E1 N( w3 L# I- yPersons who wish to acquire, renounce or restore Chinese nationality, with0 T! q: u9 G$ ]5 P# h2 U& \
the exception of the cases provided for in Article 9, shall go through the
' I) @' ], f, }# Y' h7 hformalities of application.  Applications of persons under the age  of  183 Q2 S9 e8 @  T1 D, [
may  be  filed  on  their  behalf  by  their  parents   or   other   legal. I8 e# t3 f. q* Z; f0 a- ]
representatives.
1 B* J- b6 _( g8 S3 hArticle 15
8 Y# U" P. L  U! Y( o" l- oNationality applications at home shall be handled by the  public  security" e/ j/ D0 n; u3 E5 W$ W$ G
bureaus of the municipalities or counties where the applicants reside;
0 G+ @& r& Y% U* k$ inationality applications abroad shall be  handled  by  China''s  diplomatic
" M2 R. i# h% f" u/ J$ I# Qrepresentative agencies and consular offices.9 T! o0 p6 @  c; c
Article 165 w/ f+ r$ L! j  v
Applications for naturalization as Chinese nationals and for  renunciation
* e8 o: w1 m1 uor restoration of Chinese  nationality  are  subject  to  examination  and- C  C3 B8 O" k4 E, ?; @) F
approval by the Ministry of Public Security of the  People''s  Republic  of3 [/ L- T7 `2 F: J( D8 w
China. The Ministry of Public Security shall issue a  certificate  to  any1 {' _) b  Q, N9 {# ~: `+ F$ M
person whose application has been approved.
% ?3 E1 w* P4 L1 c% sArticle 17  |! v5 a, d4 K( k
The nationality status of  persons  who  have  acquired  or  lost  Chinese5 _& X% k) i: K; e* s7 P8 d$ T
nationality before the promulgation of this Law shall remain valid.
( M+ g' ?- q  H# n/ E) D5 S+ c# SArticle 18( g/ T" q: I5 N. |8 j9 |
This Law shall come into force on the day of its promulgation.
