% [  p, S2 B6 Z" m$ X 第一条   中华人民共和国国籍的取得、丧失和恢复,都适用本法。' Q" K9 H9 \' f4 N4 R$ s1 B
    第二条   中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。
: Y( u0 [) o! `/ g" l    第三条    中华人民共和国不承认中国公民具有双重国籍。# L' a8 j/ |8 s
    第四条   父母双方或一方为中国公民,本人出生在中国,具有中国国籍。
! K$ u7 u$ L( [/ Z# T    第五条   父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。! h3 I. _8 V$ C4 S1 d
    第六条   父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。+ D+ u9 s# i3 T: @
    第七条   外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:+ l. ~; W- B! p
    一、中国人的近亲属;' S9 d! h- {/ d5 V4 V2 |
    二、定居在中国的;# @$ N: `1 ~# w. z
    三、有其它正当理由。, z* A. ~1 A; d7 D1 W
    第八条   申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。
+ F! H; U6 I$ S) @    第九条    定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。
. X! T; @! f; {7 h/ q. j: B. ~    第十条    中国公民具有下列条件之一的,可以经申请批准退出中国国籍:
. g) e6 n; @- o" z% p, g$ |4 |    一、外国人的近亲属;: z# P7 l* M; ]3 z" Y* ~
    二、定居在外国的;3 C; e! j  r2 Z3 U; G+ q- U9 h
    三、有其它正当理由。
  _# V! g/ q7 x/ x, {9 G    第十一条    申请退出中国国籍获得批准的,即丧失中国国籍。
- H% F0 o9 s" y  w! D0 D, ?4 i1 i    第十二条   国家工作人员和现役军人,不得退出中国国籍。
% \- W, }9 c( V4 `+ x# Q( A  W    第十三条   曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。) z3 ?/ {, z  i3 z
    第十四条   中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。
: v  j! F/ m+ o  A6 x- e    第十五条    受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。) |0 w" K: M& P1 M
    第十六条   加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。
- q$ ~- h! r' [1 o8 g8 I    第十七条   本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。

' l- j% i& X2 p% Q" ?2 B* @This Law is  applicable  to  the  acquisition,  loss  and  restoration  of; ]* ~0 A0 |4 g  g4 x$ z" O
nationality of the People''s Republic of China.* |6 D5 l5 c7 A* z# C5 D
Article 2; Y& e  {& k3 t, n9 a/ m/ {/ q  v, c
The People''s Republic of China is a unitary multinational  state;  persons
7 Q! l0 V' t; H+ g  b) x* ebelonging to  any  of  the  nationalities  in  China  shall  have  Chinese
' v9 R4 c* @) T7 Z2 Y5 r, Hnationality.

! M  e# i* l  B8 @The People''s Republic of China does not recognize dual nationality for any7 r8 S0 a# z3 f/ a+ V$ z
Chinese national.* x- X% q% W3 z/ [3 F8 q- B
Article 4  M# t) i7 d6 g6 F4 m4 T7 w
Any person born in China whose parents are both Chinese nationals  or  one6 e8 N( r; x2 ?* ~' v0 |
of whose parents is a Chinese national shall have Chinese nationality.

Any person born abroad whose parents are both Chinese nationals or one  of  m+ K  H9 D! c" y" I7 K) n
whose parents is a Chinese national shall have Chinese nationality. But  a: Y, V- y0 W& k/ ?) R6 E* L- [* O8 l
person whose parents are both Chinese  nationals  and  have  both  settled/ a$ m1 r: h+ p  a1 H
abroad, or one of whose parents is a  Chinese  national  and  has  settled9 b, D- R9 P9 \/ D  _1 z# j
abroad, and who has acquired foreign nationality at birth shall  not  have- p7 o/ X9 d' ?; ~' |
Chinese nationality.
+ I/ I  a  h- q, X6 g( VArticle 67 N4 n7 O8 Z2 t
Any person born in China whose  parents  are  stateless  or  of  uncertain) S5 d' f5 S& S8 \' O( A' P
nationality and have settled in China shall have Chinese nationality.
/ I5 i3 c+ n! a; S) C  sArticle 7, X$ V' z4 a/ {
Foreign nationals or stateless persons who are willing to abide by China''s* D4 C* I: Z# w9 i
Constitution and laws and who meet one of the following conditions may  be+ l5 Y( P/ E  s6 T% x* w
naturalized upon approval of their applications:
8 X# }, V5 O( Y. ^; I(1) they are near relatives of Chinese nationals;
% T: s8 b4 ]1 u' F(2) they have settled in China; or
7 X" n6 U6 E1 I& T8 F(3) they have other legitimate reasons.
# [' S" I* F3 R* P0 _0 FArticle 8
8 T3 w+ m; q5 l2 d: T# mAny person who applies for naturalization  as  a  Chinese  national  shall
9 p2 J$ H: w3 }& [. xacquire Chinese nationality upon approval of  his  application;  a  person$ O' t3 d+ I' m! m' r( ^
whose application for  naturalization  as  a  Chinese  national  has  been
* W. Q8 j' }7 a. F8 h3 \. ?! lapproved shall not retain foreign nationality.0 C1 _6 F5 f% a& c' p
Article 9" a7 S& x+ o5 l! O" d
Any Chinese national who has settled abroad and who has  been  naturalized% k% E& o6 f6 e( x
as a foreign national or has acquired foreign nationality of his own  free
: [& V# X" `" W' G' ~& b2 ]+ ]) |will shall automatically lose Chinese nationality.6 S( G2 x& Z$ [9 _* x; U3 [
Article 104 j0 h0 d! ?/ B; }- B
Chinese nationals who meet one of the following  conditions  may  renounce
8 v' e# N5 L4 pChinese nationality upon approval of their applications:4 w- l! y+ A1 `4 G9 M- u5 W) P! |$ s
(1) they are near relatives of foreign nationals;$ ]6 h# M0 _$ Q# h
(2) they have settled abroad; or
6 `) ~4 b/ N. S+ i(3) they have other legitimate reasons.

( Y; j5 E* A& S# o2 Z3 a- kAny person who applies for renunciation of Chinese nationality shall  lose- y5 T: _3 o( C" u
Chinese nationality upon approval of his application.5 r2 @* p0 p0 r- y& E: p
Article 12" _3 [' @( X! k
State functionaries and military personnel on  active  service  shall  not" ]# }2 G  d: {* y
renounce Chinese nationality.

3 ~+ n8 @8 D( {6 c, m) y* c6 I: cForeign  nationals  who  once  held  Chinese  nationality  may  apply  for
$ Z7 H( s1 }9 A# j$ jrestoration of Chinese nationality if they have legitimate reasons;  those( Y  A" p; _; S
whose applications  for  restoration  of  Chinese  nationality  have  been5 \: p0 `' h7 A/ @
approved shall not retain foreign nationality.6 H' O8 }- q+ C( t9 y
Article 14, ?! t6 ^* k& a9 x
Persons who wish to acquire, renounce or restore Chinese nationality, with* t5 l9 l& j1 Y4 H# r6 N
the exception of the cases provided for in Article 9, shall go through the
! g& B- Z2 K9 Q" mformalities of application.  Applications of persons under the age  of  187 f. s5 m" M" ~8 n8 y9 M
may  be  filed  on  their  behalf  by  their  parents   or   other   legal
* B  L8 Q$ b8 }  E5 h" d( Irepresentatives.
5 q1 |4 P$ o( u7 M" aArticle 15. L) ]7 i7 r5 M" |, n
Nationality applications at home shall be handled by the  public  security' T8 Y4 [" z1 h0 ~* s# ^' U5 p
bureaus of the municipalities or counties where the applicants reside;
: q! J8 d$ l, P% R+ {nationality applications abroad shall be  handled  by  China''s  diplomatic+ \. ]! e6 T3 q- G
representative agencies and consular offices.4 A/ T% }4 w4 G; ]; W. J0 S4 J
Article 16
9 w- U( n* ]: ~% X; n# g' n0 vApplications for naturalization as Chinese nationals and for  renunciation
3 y, @; Q- \2 ]7 e+ |3 Ior restoration of Chinese  nationality  are  subject  to  examination  and
* j9 w1 [9 Y) x# E; oapproval by the Ministry of Public Security of the  People''s  Republic  of  a) d, H2 Z6 A1 f
China. The Ministry of Public Security shall issue a  certificate  to  any
3 Q1 N- t. I# a8 b  j6 m0 k! E4 kperson whose application has been approved.. h. a6 H  s( L& r) ]
Article 17
2 x( J" ^& h+ F; p% eThe nationality status of  persons  who  have  acquired  or  lost  Chinese
2 G7 H  r; R+ t# z% q5 Vnationality before the promulgation of this Law shall remain valid.
+ n; _9 d2 M" v' v# p! Y. F7 S9 K/ xArticle 18, z: {; S: Y0 z* c9 ~
This Law shall come into force on the day of its promulgation.
