" t3 Y- ?# {3 g" l 第一条   中华人民共和国国籍的取得、丧失和恢复,都适用本法。' ^0 C- `5 U' E7 N" W( b% A3 T% F
    第二条   中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。& k5 c% x9 Q3 [  @$ \
    第三条    中华人民共和国不承认中国公民具有双重国籍。! a6 p$ k1 P6 W& L$ k" y
    第四条   父母双方或一方为中国公民,本人出生在中国,具有中国国籍。
: M& Q4 d* f0 j    第五条   父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。
5 ?" U5 k0 x4 j* t% T    第六条   父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。4 Z4 C7 W( F8 e. \
    第七条   外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:  S' L% C* r7 a' x
    一、中国人的近亲属;
6 F# j% F* f/ F& G    二、定居在中国的;
% ?2 p/ I+ I$ H& `# c    三、有其它正当理由。6 Q9 w+ W. G+ a
    第八条   申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。  Y8 y/ Y9 ?' b$ \- N
    第九条    定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。
8 K1 r* f+ P4 q4 J2 s# o9 I( j8 x    第十条    中国公民具有下列条件之一的,可以经申请批准退出中国国籍:
  ~* \: U) a' N  y! K4 n& l    一、外国人的近亲属;
' H! f; U" T) s" \    二、定居在外国的;
. o; p1 G" b4 s7 u0 X+ b% |. {    三、有其它正当理由。0 D; h- z/ f7 A7 |- p& M- D3 z
    第十一条    申请退出中国国籍获得批准的,即丧失中国国籍。
% ]0 F# [0 F; i  B2 l    第十二条   国家工作人员和现役军人,不得退出中国国籍。" i7 v- m, S) @  D% N* C
    第十三条   曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。
/ F/ G) o7 Y5 k    第十四条   中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。" d" x7 I, p4 [
    第十五条    受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。
1 P* _4 }/ E7 l' W* Z6 w    第十六条   加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。( x5 E4 a# U; t5 o' [
    第十七条   本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。
+ s' K& N, X# V  v3 E    第十八条   本法自公布之日起施行。

Article 1: a, r2 q( I7 L
This Law is  applicable  to  the  acquisition,  loss  and  restoration  of$ i( h4 ?6 ?. X4 L
nationality of the People''s Republic of China.
1 j4 K+ k0 p+ l9 J6 Q% PArticle 2
0 ], \. ^9 n+ _& `The People''s Republic of China is a unitary multinational  state;  persons
. {+ H% A5 V5 g+ Y1 m. ubelonging to  any  of  the  nationalities  in  China  shall  have  Chinese
6 L& e# t- d, Q8 jnationality.; f# v( Q7 g6 E; s+ o) Y
Article 39 `9 A/ Y1 K& b. ]! \1 K4 d5 j
The People''s Republic of China does not recognize dual nationality for any
3 ?! z$ u' S) W) j2 j' BChinese national.7 O. [4 P% V, R% f2 j4 J
Article 4/ M: D. b- S1 p6 D( K* Q' W% Q
Any person born in China whose parents are both Chinese nationals  or  one0 P6 @/ O& [% d9 s0 S3 |
of whose parents is a Chinese national shall have Chinese nationality.
$ G' i& N' O& u9 ZArticle 5
. D) v" f, M# i/ \Any person born abroad whose parents are both Chinese nationals or one  of
- }9 S0 T0 t; U3 i) b6 W8 Zwhose parents is a Chinese national shall have Chinese nationality. But  a
$ U, p* i& j2 F& ^7 [0 z( I: cperson whose parents are both Chinese  nationals  and  have  both  settled" q) ~7 a3 F# h& i! f1 P
abroad, or one of whose parents is a  Chinese  national  and  has  settled4 G) ~& a0 }% x( K4 i/ A" `
abroad, and who has acquired foreign nationality at birth shall  not  have- q$ |& P* v! }, Z6 a
Chinese nationality.
$ {9 ?7 I+ u* ?0 z$ D2 bArticle 6' F. Q- m) A2 g  p
Any person born in China whose  parents  are  stateless  or  of  uncertain
* \( Q8 R" m: V  P; c0 G, Gnationality and have settled in China shall have Chinese nationality.
; m5 \3 m* C) }7 FArticle 7
; o/ {+ A5 `) x. c0 S' kForeign nationals or stateless persons who are willing to abide by China''s+ u5 C2 x9 q3 @, S
Constitution and laws and who meet one of the following conditions may  be# b* k" f3 ?% ~4 F  u
naturalized upon approval of their applications:  G% P: F! J( n+ [3 d
(1) they are near relatives of Chinese nationals;! Z7 w/ E7 ]/ v0 c( I" D
(2) they have settled in China; or
( l7 \& w: |$ x6 U/ R4 s(3) they have other legitimate reasons.* h! B$ {2 d7 k# g2 h
Article 83 _$ R5 p( O0 {$ T
Any person who applies for naturalization  as  a  Chinese  national  shall
: M2 \2 Z  A# g: T* S5 e5 _5 yacquire Chinese nationality upon approval of  his  application;  a  person
* w3 H9 t# H. n4 ]; m  ^. |. Awhose application for  naturalization  as  a  Chinese  national  has  been5 M; j- j2 q$ q8 D1 g
approved shall not retain foreign nationality.6 z' }1 p* u1 P+ ^
Article 93 a, f2 c4 m4 X  @8 Z
Any Chinese national who has settled abroad and who has  been  naturalized: q' e' e. }+ V6 a' \$ z
as a foreign national or has acquired foreign nationality of his own  free- u- \' B1 Q6 j7 f% ^5 D' e
will shall automatically lose Chinese nationality.
4 O3 |0 C0 X- V* ?Article 10
6 {! N6 S  V+ k. T% H# }5 [0 {Chinese nationals who meet one of the following  conditions  may  renounce, b  b1 y" F) t5 ^
Chinese nationality upon approval of their applications:
3 @! J9 |% r7 F, p(1) they are near relatives of foreign nationals;
) [3 X/ r0 H6 z  v0 Z(2) they have settled abroad; or( o+ i# s/ |3 H, u
(3) they have other legitimate reasons.# H( b* K" B( C
Article 11; z* x6 ]1 L1 P3 q! J! z/ A
Any person who applies for renunciation of Chinese nationality shall  lose) T: W5 o& W) H; N
Chinese nationality upon approval of his application.
! Q; W) H$ s' C7 }4 AArticle 12  E. }" Y* Z& k! p! B, [! t4 A
State functionaries and military personnel on  active  service  shall  not; b1 g( \; n: [0 A3 B* r+ T# V+ `1 ]
renounce Chinese nationality.
: h  m* A% W. b& E& _Article 13
' i! X) K* K+ ?- I0 [5 S/ DForeign  nationals  who  once  held  Chinese  nationality  may  apply  for
( b3 \* t  J9 ~' N+ Jrestoration of Chinese nationality if they have legitimate reasons;  those3 J+ S% C/ h0 g: U* P1 V! P/ _
whose applications  for  restoration  of  Chinese  nationality  have  been/ ?3 D3 `$ n0 |& s  E8 j0 X
approved shall not retain foreign nationality.
6 g: {3 H3 J" {+ t5 z: aArticle 14! d7 @+ U+ l& R6 I
Persons who wish to acquire, renounce or restore Chinese nationality, with
- q; ^  d( K% e! v0 \& Fthe exception of the cases provided for in Article 9, shall go through the
- ~' g( F$ W2 V  ?! b5 W5 ~) mformalities of application.  Applications of persons under the age  of  18) o- m7 \7 m( _, }% B) D
may  be  filed  on  their  behalf  by  their  parents   or   other   legal' c* s2 c+ v8 X7 D. ?
representatives.' q! e% j6 O0 L0 ?% k# n# S
Article 15
! a/ P0 }' D! sNationality applications at home shall be handled by the  public  security! p7 I$ D& M8 {, L
bureaus of the municipalities or counties where the applicants reside;$ d8 w  I! r1 n% I3 |* p
nationality applications abroad shall be  handled  by  China''s  diplomatic
  T8 Z. Z* p/ Vrepresentative agencies and consular offices.
! o! ]- u+ g' t$ h) b6 k7 GArticle 160 E4 g0 p+ J3 S0 Q) N& `
Applications for naturalization as Chinese nationals and for  renunciation
1 ?' x1 I' Z. {- b; tor restoration of Chinese  nationality  are  subject  to  examination  and
5 z3 O) R# z, bapproval by the Ministry of Public Security of the  People''s  Republic  of1 l6 i/ \5 ^$ |: c6 n. P: X
China. The Ministry of Public Security shall issue a  certificate  to  any
5 d- m9 M0 |" t, x6 vperson whose application has been approved.
+ r( G( a4 A# l8 xArticle 17% b% w- R9 o5 `; d/ }9 P
The nationality status of  persons  who  have  acquired  or  lost  Chinese
0 H( ~. c9 d3 Xnationality before the promulgation of this Law shall remain valid.
, u4 n' V' p; u  g" f/ NArticle 18: @! I" s+ P/ e2 Q+ c1 S
This Law shall come into force on the day of its promulgation.
