第一条   中华人民共和国国籍的取得、丧失和恢复,都适用本法。
; R7 G' J7 u, h0 S& Y9 h2 P    第二条   中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。0 n! ?% A" ?9 P' K
    第三条    中华人民共和国不承认中国公民具有双重国籍。0 o2 \( k: K; l& s) @
    第四条   父母双方或一方为中国公民,本人出生在中国,具有中国国籍。5 c7 ?4 Q6 @* W
    第五条   父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。
) }9 z4 V( E. B5 i: ~/ i    第六条   父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。% ?7 A9 {7 D! e" W
    第七条   外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:
/ z. `. x; f. A+ A    一、中国人的近亲属;# u" Q% F$ f2 ?. p: i" s
    二、定居在中国的;
1 @& f0 v! _: F( {    三、有其它正当理由。- |, ?& g, F( ?7 |2 K
    第八条   申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。) X: u# v2 z6 g- ^( F" s
    第九条    定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。) _) z7 u% k5 q5 j8 C7 g
    第十条    中国公民具有下列条件之一的,可以经申请批准退出中国国籍:8 u0 H! o( D3 N8 P6 @2 V
    一、外国人的近亲属;
( Z! G' L2 f) {, n6 w( Q; d6 L    二、定居在外国的;
' o9 t; [. V$ C: D    三、有其它正当理由。
: k9 D  P+ N( y! E# ?- w& P    第十一条    申请退出中国国籍获得批准的,即丧失中国国籍。
- D: S2 I0 s/ c    第十二条   国家工作人员和现役军人,不得退出中国国籍。/ x" \" D+ R! X! i: I4 J& \
    第十三条   曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。, x: {1 `# j2 I1 ?4 o: t
    第十四条   中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。
! f! b0 ]( H+ D  D3 w# _2 B) y    第十五条    受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。
' \4 x. z. K$ j; F7 b; t    第十六条   加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。

Article 1' @' z* ~; R5 A% v$ b
This Law is  applicable  to  the  acquisition,  loss  and  restoration  of
3 ?) {- ~9 B, _" |7 c  ]nationality of the People''s Republic of China.4 }! M0 n- A: j0 p# ^4 @) I7 h
Article 2
2 E/ }6 h" d# b' t+ yThe People''s Republic of China is a unitary multinational  state;  persons! k+ N* W) f+ u
belonging to  any  of  the  nationalities  in  China  shall  have  Chinese+ X% }& P* a4 {

Article 32 d7 w5 l  I: p0 ^) P1 ]
The People''s Republic of China does not recognize dual nationality for any
4 L  F: e$ j& I% U9 mChinese national.0 Y" L* i3 h( y
Article 4" ^+ }2 x3 ^. {, T; I% B$ P
Any person born in China whose parents are both Chinese nationals  or  one7 A+ q2 v6 }  W# l
of whose parents is a Chinese national shall have Chinese nationality.: m5 a9 P! N7 g
Article 5
: }" r! W8 d* V- U. ]+ yAny person born abroad whose parents are both Chinese nationals or one  of
+ x8 U4 B2 L; S* K0 d8 j5 Nwhose parents is a Chinese national shall have Chinese nationality. But  a2 p: o6 o0 P! v- ]: Z
person whose parents are both Chinese  nationals  and  have  both  settled
* R* A. `7 P2 D' Sabroad, or one of whose parents is a  Chinese  national  and  has  settled
: g  _! h5 C% y) n7 Aabroad, and who has acquired foreign nationality at birth shall  not  have2 G; [" n; y0 E
Chinese nationality.1 B9 T1 H4 n  h" w2 S6 Q
Article 66 g2 l4 f6 N: A* [
Any person born in China whose  parents  are  stateless  or  of  uncertain! v7 @7 s! `" U# [9 e
nationality and have settled in China shall have Chinese nationality.
* \  ~$ m) T7 p+ O- I7 o" lArticle 7& F/ l0 e. f1 F( n3 F+ _
Foreign nationals or stateless persons who are willing to abide by China''s3 q1 Z0 H7 N& ?) D8 I1 T
Constitution and laws and who meet one of the following conditions may  be. O( `4 x6 X! k8 i/ L
naturalized upon approval of their applications:5 y* W0 M4 E+ p' F# j. {1 ~
(1) they are near relatives of Chinese nationals;
. H, ], |* L. g$ p(2) they have settled in China; or
& d9 L! n. l9 I5 T(3) they have other legitimate reasons.
$ _) R) U8 t" D4 A5 ?Article 8
; u" W; @. |; t) N6 rAny person who applies for naturalization  as  a  Chinese  national  shall
5 W' a7 y) [2 _- x) I( }acquire Chinese nationality upon approval of  his  application;  a  person
( M5 V: R/ ^6 J% s; w$ u" h5 iwhose application for  naturalization  as  a  Chinese  national  has  been
& B, s+ T7 y2 aapproved shall not retain foreign nationality./ b- T2 y& V9 p* j
Article 9/ d3 c& J" J7 u5 Y9 S! C
Any Chinese national who has settled abroad and who has  been  naturalized0 H3 \; A7 C- L/ V( Z
as a foreign national or has acquired foreign nationality of his own  free$ @# H! W* a# T( Z; I
will shall automatically lose Chinese nationality.
* Z% y8 Z5 ]" W% G' f4 [( ~, [Article 10/ @( e2 C+ j" _0 a( w7 ^
Chinese nationals who meet one of the following  conditions  may  renounce
6 M& V$ c" K( [( P( lChinese nationality upon approval of their applications:
4 Z) d1 w) W, k) \(1) they are near relatives of foreign nationals;. \1 p* D1 d' c  m# K
(2) they have settled abroad; or$ u) l+ v, Q; U: q( n  ?9 ?
(3) they have other legitimate reasons.

+ j- o$ u( g& F( X; SAny person who applies for renunciation of Chinese nationality shall  lose
9 u3 A  Q# o, r$ x1 Q# G! T0 aChinese nationality upon approval of his application.
9 ]" S& i( V& c: g5 EArticle 12
, L4 _- e; \  \0 ZState functionaries and military personnel on  active  service  shall  not
/ L/ q& H# H+ h+ K7 trenounce Chinese nationality.1 D( [/ c1 q" j" z& x) J
Article 134 U. _3 r& E' I9 |& `
Foreign  nationals  who  once  held  Chinese  nationality  may  apply  for
- u) p4 R+ x0 [  \, m: nrestoration of Chinese nationality if they have legitimate reasons;  those
4 k# s% {5 ^, G) x: ]. Dwhose applications  for  restoration  of  Chinese  nationality  have  been' Q# m3 z0 q4 |. G; q3 v/ r3 K
approved shall not retain foreign nationality.( ?6 ~2 |8 j6 w, x  m
Article 14
/ v' U: z: \  k1 e  p9 BPersons who wish to acquire, renounce or restore Chinese nationality, with! R& e+ X4 o4 Q6 O; a/ G* f4 d
the exception of the cases provided for in Article 9, shall go through the
+ g% ~$ o- `$ v6 b. v  F' hformalities of application.  Applications of persons under the age  of  18
$ @3 T- @) D# `may  be  filed  on  their  behalf  by  their  parents   or   other   legal
! Z7 D& `  b. P; p- q1 \representatives.
. `9 S0 h3 F" ~+ Z. n  Q# G2 BArticle 15. m; P: z6 G6 e6 ^7 F) C6 Y
Nationality applications at home shall be handled by the  public  security
  A$ t( N0 Q; h% \$ x5 t6 Dbureaus of the municipalities or counties where the applicants reside;
: R( N9 S7 f+ p+ enationality applications abroad shall be  handled  by  China''s  diplomatic
3 q+ E3 T$ j$ Krepresentative agencies and consular offices." f) P+ \* @! l# w) h8 B) P( _1 h
Article 16
& J8 V8 |+ H& T6 U' m! M" g3 [  P5 rApplications for naturalization as Chinese nationals and for  renunciation
5 A0 B4 ~1 I/ y, dor restoration of Chinese  nationality  are  subject  to  examination  and
2 S8 q" X; A0 }# u4 A4 ?7 h7 {$ Zapproval by the Ministry of Public Security of the  People''s  Republic  of
7 z- {" m( P6 j( ~6 z+ t4 pChina. The Ministry of Public Security shall issue a  certificate  to  any& C: }* r3 M# A" ?
person whose application has been approved.
) G: G: S( ^& d# a( qArticle 17
. B+ A! ~5 S& o, T' vThe nationality status of  persons  who  have  acquired  or  lost  Chinese7 X+ t' s' J, ~  B/ e8 m+ \
nationality before the promulgation of this Law shall remain valid.: Z* J' {  o7 c4 V* y' g& x0 y
Article 18
2 D4 }' R' j- d/ e! p" n5 oThis Law shall come into force on the day of its promulgation.
