和邻居关于fence的争议

邻居要求换fence，但我觉得不需要换。因为他们是rebuild，想要把landscaping做漂亮点，可我的房子在出租，自己不去住，fence并没有倒塌只是有些旧，所以暂时没这个预算。邻居给的报价是4000 in total，是给他做landscaping的公司，我算了一下大概$50/linear ft，好像并不便宜. 我说我今年没有replace fence的budget，他短信我，

I'm not asking. You have a legal obligation. If you disagree with replacing the rotting deteriorating and unsafe fence the matter will be forwarded to a legal mediator to deal with.

本来也不是不可协商，但是非常不喜欢他这种“威胁式”短信。

请问大家有什么建议？

你邻居车库加盖出来的面积太大了吧．可能已经违法了，你测量一下，然后去市政府问问他有没有许可．

如果我不同意修，我邻居可以自行拆掉现有的fence换新后，把账单寄给我强行要求我付钱吗？

If I were you. I would make sure the old fence is your land or his land or the middle.

If the whole fence is in his land (your neighor built the fence before), do not say anything at all; if the whole fence all in your land (your previous owner built the fence), you shall make sure that the fence is safe and the neighbor has no right to say anything or remove or place. He can build another fence in his land close to yours;

If the fence is in the middle of both land, means you two both own the fence. In that case, you have to either repair or replace or remove the fence together with your neighbor. You may not need to pay for the new fence if you do not agree, but you most probably have to pay for the removing old unsafe fence...

By the way if you do not agree with cost of the fence, you may ask for another quote to let your neighbor know.

不同意换新的，但是这个FENCE 看来还是需要维修的。出租更加要注意，租客受伤跟麻烦。

找你的Real Property Report，然后量一下，一般这个信息是律师给的。

Call 311 municipal city. But u may have to pay for the plan. Normally u shall have one from previous owner when u buy a house.

在Surveyor Report(Real Property Report) 上有一个Compliance 的盖章和日期。地产成交时卖方必须提交给你的。

这个状况，看起来需要修整一下。与邻居的关系，尽管是出租房，维持在外交礼节性的为妙。谁知道他们什么时候策反你的房客，来搞你房东。。。这个是防不胜防的。因为大体上讲，房东和房客的利益是对立的。房客当然希望全换新的，再加邻居吹风。若房客本身就不是和善之辈，更应注意。

我也觉得这么破的Fence有必要修或者换。。建议楼主还是从了吧，不过可以找个便宜的，4k太贵了。。我家两边fence的木头，Post，钉子，油漆等材料花了2500左右，邻居做了全部人工，一边收了我200块，一边没要钱。

为什么邻居愿意盖，就不得不同意？你直接说：这个太贵了，找个便宜的公司来做，不接受不就完了。

I do not think you have any obligation to pay, call 311 and ask what your options are in this situation. My neighbour agreed to pay 1/2 of the fence cost, and after I sent the bill to them, they claimed they had no money. So, what coudl you do?

ON the other side, if it is your rental place, you have the obligation to make sure it is safe for your tenant.

测绘公司可以做Real Property Report，价格在500左右。目测你邻居家的eaves are located on your lot，Real Property Report做出来后他会有麻烦
